Court Laws
Being judged by your fellow leaders is a new system being put
into place in an attempt to give TRU members a fair chance to
have their case heard by someone besides the Leader who kicked
them out or blacklisted that member.
It's easy how this new system will work, like a court of law.
SECTION 1: INTRODUCTION
1. If a member thinks he or she has been kicked out (DNH'd)
wrongfully, that member has the right to file on the TRU forums
for an appeal to be heard by the judges from the TRU Gaming
Network.
2. It should take no more than two weeks for the accused member
to have a verdict for his or her case.
3. Members will need witnesses and proper paper work in order to
be heard.
4. The Leader or person who has banned/kicked out the member
must prosecute with evidence and witnesses.
5. In the event the Leader doesn’t show up the case will be
dismissed without the accused member having any penalties.
6. Other types of cases can be filed for the TRU court to hear.
SECTION 2: SENTENCING
1. Penalties for the member will have to be decided by the
judges hearing the cases.
2. The judge’s panel will deliberate for as much time as needed.
Deliberation will not start until the proper steps are taken.
3. Each member is allowed one appeal per offense, no member will
be charged with the same offense twice.
4. If a member commits the same offense twice, no appeal will be
needed; ban will be automatic and permanent.
SECTION 3: CONTEMPT OF COURT
1. Any member that files a case does not have the right to argue
at any time with the judge’s panel. Nor do their witnesses.
2. The judge’s panel runs the court and in the event the member
or anyone else gets out of line with the judges panel, then the
judges’ panel has the right to throw out the case or the members
disrupting the court. So let’s try and keep the hearings
professional and civil for all members.
3. If a case is thrown out of the TRU court for a the Defendant
or Witness disrupting a court session they may not be able to
appeal their case. This will be decided by the judges and the
judge who threw the member out.
4. See JMAZ’s topic about posting in the area.
5. ANYONE, other than a Judge, Mod, Global Mod, or Admin, who
overrules the court's decision in any way or goes against it
WILL BE PUNISHED.
SECTION 4: PROCEDURES WHILE APPEAL IS BEING PROCESSED
1. Members who have filed a case and are awaiting to be heard
will give up squad tags and their status until their case is
heard within two weeks of the incident at hand.
2. Members have the choice to leave the TRU Gaming Network while
waiting for their case to be heard.
3. If the Leader of the member who has filed a case does not
want that member in his or her division, that member will have
to leave or be put into a Division where he or she can stay
until court time. The where about of the member will be decided
by the Leaders of each Division or Squad.
4. If the member is in a new area, he or she will not try and
cause trouble for that Leader. If the member does try and make
trouble the leaders have the right to make that member leave TRU
and it will help the case of the Leader.
SECTION 5: CONDUCT AND AUTHORITY OF PRESIDING JUDGES
1. New Judges will be voted in by the current judges in place.
2. The Chief Justice will preside over every case and have the
final say over every case with the help of the other presiding
judges.
3. A judge must excuse themselves in any case that would be
considered a conflict of interest.
4. If the judge doesn’t step down and the court finds the case
to have been a conflict of interest on the judges part, then the
judge will be warned. After a judge has THREE offenses he or she
will be removed from their position. The Chief Justice cannot be
removed or replaced since he was appointed to run the court and
helped create it.
5. If a judge is caught not being fair towards members that have
filed a case, he or she will then lose his or her judgeship.
6. Judges have the full right to issue a subpoena to any member
who is needed for the advancement of a court case. Anyone who
goes against the court case will be held in forums contempt,
which will be a one day ban from posting. Contempt punishment
will increase with each issue.
7. A judge has the right to pass any case for a few days to give
TRU Gaming Network or the member who has filed the case an
opportunity to find a witness that needs to testify in any given
case.
8. Members or Leaders have TWO weeks from time of incident or
discrepancy to file for a case to be heard by the judges. If the
discrepancy has been longer than two weeks, then the case CAN be
thrown out.
All case filings must be filed in the TRU APPELLATE COURT area
of the TRU forums located below:
TRU Appellate Court
TRU believes that by holding an Appellate Court that we can
better serve our ever growing Community one member at a time. By
giving every TRU member an opportunity to have their case heard,
is yet another way to give all members a second chance to be a
member of the TRU Gaming Network.
SECTION 6: DISCLAIMERS AND OTHER POLICES/REGULATIONS
1. These rules are subject to change at any time without
notification.
2. The TRU Gaming Network will not be at any time held
responsible for the outcome of any TRU held court proceeding.
3. By filing a case with the leadership of TRU, you have given
up your right to be considered a member of the TRU Gaming
Network.
4. TRU management has a ZERO tolerance for members that break
the code of conduct and or any laws of the land.
5. The TRU Gaming Network will continue to report any laws being
broken that we have knowledge of to the proper authorities.
6. The TRU Gaming Network is not a court-of-law and only uses
the TRU Court hearings in order to give everyone a fair and
balanced hearing before taking membership privileges away from
our members.
7. The TRU Gaming Network will not be held reasonable for
members who chose to purchase a gamer tag with "TRU" in their
name.
8. The TRU Gaming Network does not ask members to buy a TRU
gamer tag to become a member of the TRU Gaming Network, we only
encourage members that would like to receive rank within the TRU
Gaming Network to have a gamer tag if that member wants one.
All TRU Leaders have an Open Door Policy to speak with members
on any issues that a member may have. We do encourage our
members and Leaders to try and work through any issues they may
have, our Leaders should try to bring in a mediator to work
through these issues.
