Justice Dept. Eases Pre-Election Constraints on
Investigating Election Fraud
For decades, federal prosecutors have been told not to mount
election fraud investigations in the final months before an
election for fear they could depress voter turnout or erode
confidence in the results. Now, the Justice Department has
lifted that prohibition weeks before the presidential election.
The move comes as President Donald Trump and Attorney General
William Barr have promoted a false narrative that voter fraud is
rampant, potentially undermining Americans’ faith in the
election.
A Justice Department lawyer in Washington said in a memo to
prosecutors on Friday that they could investigate suspicions of
election fraud before votes are tabulated. That reversed a
decadeslong policy that largely forbade aggressively conducting
such inquiries during campaigns to keep their existence from
becoming public and possibly “chilling legitimate voting and
campaign activities” or “interjecting the investigation itself
as an issue” for voters.
The memo creates “an exception to the general noninterference
with elections policy” for suspicions of election fraud,
particularly misconduct by federal government workers, including
postal workers or military employees; both groups transport
mail-in ballots. The exception allows investigators to take
overt investigative steps, like questioning witnesses, that were
previously off limits in such inquiries until after election
results were certified.
But of course they will not be investigating stuff like the
following:
Despite declining to further extend Florida’s voter
registration deadline, Chief U.S. District Judge Mark E. Walker
berated Florida’s Republican officials for the state’s repeated
problems ahead of each election day.
On Florida’s official voter registration deadline of October 5,
a heavy volume of traffic caused the state’s registration
website to crash. Secretary of State Laurel Lee issued a
directive to extend the deadline until 7 pm the following day,
but did not announce the decision until midday Tuesday. Several
civil rights groups promptly sued Gov. Ron DeSantis and
Secretary Lee for an inadequate response that failed to give
potential voters enough notice to register.
Judge Walker called the extension a ‘half measure’ and, despite
denying an additional extension, took the opportunity to rip
into the state that ‘seemingly is never prepared for an
election’ and thwarts potential voters from performing their
civic duty.
As is typical in presidential elections, Florida is projected to
be one of the key swing states that will ultimately decide the
winner of November's race.
California GOP Accused of Setting up Unofficial Ballot Drop-off
Boxes Across State
The California Republican Party has faced questions over
unofficial drop-off boxes set up to collect mail-in ballots
across the state.
Reports of such boxes, which claim to be official, have been
shared with the California Secretary of State, Alex Padilla—who
has suggested they could be illegal.
"Operating unofficial ballot drop boxes—especially those
misrepresented as official drop boxes—is not just misleading to
voters, it's a violation of state law," he said, in comments
reported by The Orange County Register.

Stewart Rhodes, the leader of a far-right group called
the Oath Keepers, told the Los Angeles Times on Saturday that
his members would "be out on Election Day to protect people who
are voting." He said some would be carrying concealed weapons.
A QAnon-affiliated group has also been talking on Telegram,
describing "heavily armed MAGA patriots" preparing for Election
Day, according to the Times.
...
He said if his group noticed, for example, protesters at polling
sites with guns, "we're going to intervene."
By this logic, we should intervene since they themselves are the
protestors at polling sites with guns! But will we?
Cassie Miller, a senior researcher with the Southern
Poverty Law Center, told the Times that "chances are really high
that we're going to see militia members, armed groups, or Trump
supporters who are armed at the polls."
"Not only are these people willing to participate in voter
intimidation, but they're hoping to create this chaotic moment,"
Miller said. "There's an unwillingness to accept anything but a
Trump victory."
So are we just going to let them walk all over us?

Microsoft takes down massive hacking operation that could have
affected the election
Microsoft has disrupted a massive hacking operation that
it said could have indirectly affected election infrastructure
if allowed to continue.
The company said Monday it took down the servers behind
Trickbot, an enormous malware network that criminals were using
to launch other cyberattacks, including a strain of highly
potent ransomware.
Microsoft said it obtained a federal court order to disable the
IP addresses associated with Trickbot's servers, and worked with
telecom providers around the world to stamp out the network. The
action coincides with an offensive by US Cyber Command to
disrupt the cybercriminals, at least temporarily, according to
The Washington Post.
Microsoft (MSFT) acknowledged that the attackers are likely to
adapt and seek to revive their operations eventually. But,
Microsoft said, the company's efforts reflect a "new legal
approach" that may help authorities fight the network going
forward.
Trickbot allowed hackers to sell what Microsoft said was a
service to other hackers — offering them the capability to
inject vulnerable computers, routers and other devices with
other malware.
