"Boon told Daily Tribune Media on Wednesday morning that she
chose not to prosecute the case because she didn’t find enough
prosecutorial merit to move forward with the case as a felony.
“My point of view is there was no criminal intent, which I
believe is required by the statute,” Boon said."
She "believes"?!?! She is putting words into the text of the
       statute that just aren't there.

How does one prove intent? I could say I didn't intend to

So we elect an attorney, give them the "oath of office" and pay
them to pick and choose which laws to uphold? I understand that
some cases are not open and shut, that there may be a lack of
convincing evidence and that those cases may be dropped.
However, in this case, the junior emperor admitted to the crime
so it is a conviction guarantee. The state statute is pretty
clear and does not allow for individual interpretation of said
statute. Do DAs and judges get things correct 100% of the time?
Hell no! Did this DA drop the ball and open a can of worms?
Without a doubt. Everyone seems to be falling for the statements
by the gab that no one has been prosecuted under this law but do
you know why? The gab ONLY prosecutes campaign finance
complaints, all other complaints get filed under "g". No one
ever takes these type of complaints straight to the DA except
       for....... me!
Here is a question, which holds up in a court of law: state
       statute or precedence?

No, no, yes and yes. I'm still waiting for someone to post the
video/audio of the debate on the floor for the bill that became
this law. See, everyone called the gab and the gab agents are
the ones that filled everyones head with this crap of
buying/selling votes. Here is the kicker.... the gab DOESN"T
DEAL with this part of law, they only deal with the FINANCIAL
side( and look at the ruling that was just handed down.... egg
on the face of the gab)! Really though, the gab should be shut
down and the powers be restored to their proper departments.

Precedent carries an incredible amount of weight. It is what
       defines and interprets the law.
Steve, this isn't a big conspiracy.
The prosecutor is required to show there was intent to violate
the law, the law being violated accidentally is not enough.
It's a waste of taxpayer resources, pursuing charges that will
       not stick.

Not all laws require intent be proven. Most traffic laws fall
into the strict liability category, the violation is black and
white. Felonies often do not, or have lesser tiers based on
intent. That's the difference between Murder and Manslaughter,
       for example.
The presumption is that intent is a required element unless the
legislature specifically excluded it, as they did with drunken
       driving laws for example.
This law requires intent to defraud. Does anyone believe they
       can prove there was?

This is why we all need to start calling out crazy for what it
is. If we let it go unchecked, it wastes everyone's time and
the public's resources. Worse still, the crazies never learn a
lesson from their humiliating public failures.

It's nice to see you calling you and your party out.
