Joe Reinwand thread. again
By: 12cows Date: September 12, 2015, 4:21 pm
---------------------------------------------------------
I was looking on WCCA on how the 2nd murder trial case of Joe
Reinwand is going and folks this does not look good. It is not
that he will ever get out and harm someone as he is already in
prison for murdering Dale. The point is this is really going to
drag out and cost the taxpayers a lot of money. This is from
court record events from 8-21-2015.
Motion hearing
Defendant Joseph Bruce Reinwand in court with attorney Jeffrey
Jazgar. Defendant Joseph Bruce Reinwand in custody. Robert John
Kaiser appeared for the State of Wisconsin. 9:17 AM Court calls
case. Atty Kaiser and Atty Jazgar states their appearances.
Today's date is set aside for the first motion hearing date.
There has been a couple of motion hearing dates set. Court
received a handwritten motion from Defendant asking for new
counsel, was received August 9th, filed August 12th. Atty Jazgar
received a copy of this from the Court. Atty Jazgar addresses
the Court, does not know the Defendant's position right now.
Atty Jazgar filed a number of motions today. Court questions
Defendant. Defendant went through the motions that his attorney
filed this morning. These motions were being filed in
anticipation for September 25th, not for today. Atty Jazgar
states that a couple of the motions could be addressed today.
Court reads the motion headings, for the record. Court addresses
the motions that are to be heard today, Atty Kaiser concurs.
-Written motion and request for new counsel is addressed first.
Defendant addresses the Court, his attorney was going to work on
his request, will keep him as counsel. Defendant is withdrawing
his motion and wishes that Atty Jazgar to continue as being
counsel. Atty Jazgar addresses the Court regarding the motion
for withdraw, the volume of discovery has been cumbersome and
failed to disclose the significant problems with obtaining
everything with his client, that is where the communication has
broke down and has been resolved this morning. Court questions
Atty Jazgar regarding continuing today's hearing. Atty Jazgar
addresses the Court, replies to the issue at hand. There was a
John Doe hearing that Judge Potter presided over in Wood County,
a homicide case. There was also a John Doe in Portage County
regarding this case and Judge Potter presided over that as well.
Atty Jazgar addresses the Court, Wood County case started in
2012, 12JD-1. Portage County also has case, 12JD-1. Atty Jazgar
was aware of two different JD cases. Atty Jazgar reviewed the
Wood County case. Atty Jazgar asked then to review the Portage
County case. Clerk of Courts did not have the file, Judge Potter
had it. Atty Jazgar had access to the Portage County this
morning. Clerk of Courts is present right now in the courtroom.
Atty Kaiser is willing to accept offer of proof without Clerk of
Courts having to testify. Atty Jazgar explains to the Court
further why the file needs to be reviewed further, does not feel
comfortable proceeding not knowing what is in there. Atty Kaiser
addresses the Court, responds, believes everything was given to
Defense, including both John Does, explains how the paper
material is put on a thumb drive. 6,614 pages are on the thumb
drive, both cases and exhibits. Atty Jazgar addresses the Court,
responds. Atty Jazgar acknowledges receiving the thumb drive.
Court clarifies. Atty Jazgar wants to see the documents that are
on the thumb drive, wants to see what is in the court file so
everything is actually on the thumb drive. Atty Jazgar explains
what he has seen on the thumb drive at this time and the
incomplete paperwork that he is seeking. 14CV-193 is addressed.
Neither party has had access to 14CV-193. BY THE COURT: Court
will order the stipulation that has been entered. Atty Jazgar
will prepare the order for the Judge to sign. Atty Jazgar takes
a moment with his client. -Potential Exculpatory Evidence is
addressed next, number 2. Atty Jazgar addresses the Court,
addresses the theories in the JD file. Atty Kaiser addresses the
Court, replies. Atty Jazgar addresses the Court, replies, is at
a loss with the amount of discovery, does not have a list of
witnesses yet. -Court addresses motion for adjournment that was
filed by Defense. Atty Jazgar addresses the Court, explains.
-Number 3 Motion to Compel is addressed. Atty Jazgar explains
this motion to the Court. 06PA-12PJ is addressed. Atty Kaiser
addresses the Court. BY THE COURT: Court grants motion regarding
06PA-12PJ. Atty Jazgar will prepare the order for the Judge's
signature. -Next motion is addressed. Defense to inspect and
copy file. Atty Jazgar addresses the Court. Court reviews
statute, has not had this request before. Atty Kaiser addresses
the Court, would like to respond in writing. Atty Jazgar has
gone to DA offices previously and has inspected DA files, is not
seeking work product or notes. Court replies. Discussions
continue. Court will not rule on this motion today, will give
counsel opportunity to respond. -Motion for continuance is
addressed Atty Jazgar addresses the Court, is still plowing
through the thumb drive. Defendant has not had opportunity to
review what is on the thumb drive. Defendant will be receiving
all the discs within the next week. Atty Kaiser addresses the
Court, responds to this motion. Atty Jazgar addresses the Court,
replies. BY THE COURT: Based on the record that's been presented
here today by counsel, the Court agrees with Atty Kaiser. Court
will not force Defendant to have a trial in October with this
type of a record. Trial scheduled for October will be adjourned.
Court and counsel will meet in chambers and come up with a new
scheduling order. Atty Jazgar addresses the Court, inquires as
to the bond in this case and the conditions. Court reads the
bond for clarifications.
