Obama to close Gitmo? Really??

Despite bilateral legislation to the contrary, Obama is looking
to use his pen to close Gitmo going around members of his own
party. This at a time when the US is at war with ISIS.. Check
that. ISIS is at war with us. We aren't at war with anyone.
I think we should just simplify the process and just parachute
them into the area of Kobani Syria. They would end up there
anyway

And if he does not close it, the right will hammer it as a
failed campaign promise. Can't win either way.

You don't get it. We're at war. Whether or not you declare it
or not. The recidivism rate of Gitmo detainees is horrendous.
Do you think it's appropriate to fulfill a campaign promise at
the risk of our own National Security? Wouldn't you call that
kind of a mix up of priorities?

We house worse people in Federal Prisons, which is where these
guys should be.
Instead we house them with more of their own kind where they can
share ideas and ideology.
That's stupid. In exactly what way has Gitmo worked in our
favor?

Easy question. These guys aren't subject to our rights under
the Constitution nor should they be. They're prisoners of war.
We may end up getting a few more of these in the not too distant
future and they should be housed there as well. Or do you think
we should just give them a one way ticket back to the front
lines?

They are not POW's until we declare a war. They are considered
unlawful enemy combatants and can be tried either by the US
criminal court system or by a military tribunal. Obama appears
to favor the court system. You may not like it, but as CIC it
is his choice.
If we DO declare a war, the POW's have to be released and
repatriated when the war ends (Geneva Convention). Even if they
go home, reload and come right back.

Or instead of screwing around, declare war, get in there with
the full force of the US military and clean house.
This half-assed sorta-war sorta-not nonsense will drag on for
a decade and leaves too much of the process in legal limbo.

First, it may sound dumb but lets name this operation. Then
after naming it let's put it into action. Once you name it you
own it. That seems to be the problem however. Nobody seems to
want to own it. Then again bombing ISIS at a rate of a half a
dozen bombs per day doesn't add anything to the coffers of the
DNC. That's what's really important right now.

They sure don't. For good reason. Our political system is so
screwed up, whatever side "owns" it will be beaten over the head
with it by the opposing party. Even if it's what's best for the
country.
