kennedy is flawed!

I guess "UP HOLD THE CONSTITUTION" is just a meaningless phrase.

Well, the constitution ISN'T perfect, even the founders knew
that, which is why it can be amended. Sorry, but it wasn't made
by the magical finger of God, the founders were just mortal men
and there is no tooth fairy or Santa Claus either.
Sorry if that rattles your crazy world view.
You can uphold a law even if you think its imperfect, so I'm not
sure what you are getting at here.

Funny thing about amendments, if this is the way to change the
law why don't you instead of packing the benches with judges
that "are likely to rule in favor with Obama because he
appointed." I will admit that is not an exact quote but the
sentiment is.

Sure. Including the part allowing only white, land owning males
to vote and the part authorizing slavery? Shall we uphold that?
Kennedy is right, the founders left methods to CHANGE the
constitution because they were smart enough to know they
couldn't forsee the future.
Why is that a problem?

Because Obama is the first president to nominate like-minded
judges. :D

There is a set procedure to "change" the law which does NOT
include activist judges on EITHER side.

I can see it happening more so after the post constitution obama
era. Yes, I have a problem with both sides doing this crap.

Agreed. Problem is the definition of "activist". It doesn't
mean a decision you don't agree with. (but that's how it's
often used)

I define "activist judge" as one who disregards the letter of
the law and spins it to their own interpreted meaning.
