Snake in the bushes (no, not a band name)

Maybe about 2 months ago I was trimming back some bushes in my
front yard along the fence. When I started to trim further
back, I saw a black snake in perched up on a branch. I didn't
hurt him. I'm happy to try and accommodate nature where I can.
I suspect he hasn't ventured back up in the bushes since I'm
thinking his little snake brain tells him not to put himself in
the position to come eye to eye with that odd looking creature
with hair and a goatee (me).
This was next to my bird feeders and bird bath. Being an
opportunist, I'm guessing he/she (the black snake) was hoping to
       bag a little finch.
In other news I've spotted 2 nests up in my front yard oak
trees. The leaves are falling right now so the nests are visible
through the branches. They probably won't be after new leaves
grow out on the branches. My next door neighbor thinks both
       nests are squirrel nests.
       The snake.

...The leaves are just now falling???
I'd try to figure out what kind of snake that is, although I
       doubt it's venomous.
