[center]Historical Discovery Shows The Coal Industry Was Well
Aware of Climate Change Over 50 Years Ago[/center]
SNIPPETS:
A rediscovered journal from the 1960s reveals the
HTML https://soberthinking.createaforum.com/gallery/soberthinking/1-040622210450-1415528.gif<br
/>coal industry has understood the dangers of human-caused
climate
change for over 50 years, and may constitute the earliest known
evidence of such fateful 😈🦖 insider knowledge.
It's become clear in recent years how oil giant Exxon was aware
of the causes and consequences of climate change from at least
the 1970s, but chose to deliberately mislead the public for
decades.

The newly resurfaced evidence now shows coal executives equally
understood the science of catastrophic global warming as far
back as 1966. ... ...
The existence of the article was discovered in August by
engineer Chris Cherry from the University of Tennessee,
Knoxville, who found it in a stack of vintage journals about to
be discarded. ... ...
While much of the paper is concerned with sulphur in coal, a
small section early in the article is concerned with carbon
dioxide (CO2) discharge, and lays bare just how acutely
appreciated the "the far-reaching aspects of the air pollution
problem" actually were as far back as the 1960s.
"There is evidence that the amount of carbon dioxide in the
Earth's atmosphere is increasing rapidly as a result of the
combustion of 🦕 fossil fuels," Garvey writes.
"If the future rate of increase continues as it is at the
present, it has been predicted that, because the CO2 envelope
reduces radiation, the temperature of the Earth's atmosphere
will increase and that vast changes in the climates of the Earth
will result." ... ...
Given the unfortunate, public
HTML https://soberthinking.createaforum.com/gallery/soberthinking/1-050422182057.gif<br
/>[b] realities of pollution from burning coal[/b], in the
conclusion of his discussion piece, the Peabody engineer Jones
wondered:
"What can an individual with a
HTML https://soberthinking.createaforum.com/gallery/soberthinking/1-041022131622.jpeg<br
/>🦕 personal stake in the future of the coal industry
do?"
Among the answers,
HTML https://soberthinking.createaforum.com/gallery/soberthinking/1-080822134118-17091258.gif$<br
/>he offered this.
"Be a
HTML https://soberthinking.createaforum.com/gallery/soberthinking/1-040622153114-13822364.jpeg<br
/>'one-man' public
HTML https://soberthinking.createaforum.com/gallery/soberthinking/1-040622202527-13931485.png<br
/>relations emissary for the coal industry," Jones explained to
his industry colleagues.
"Tell your neighbours, friends, and the general public how
HTML https://soberthinking.createaforum.com/gallery/soberthinking/1-040622202527-13931485.png<br
/>important coal is to their every-day existence. Also tell them
about
HTML https://soberthinking.createaforum.com/gallery/soberthinking/1-040622202527-13931485.png<br
/>the all-out cooperative efforts of the coal industry to reduce
air pollution."
HTML http://renewablerevolution.createaforum.com/gallery/renewablerevolution/1/3-250718202127.gif<br
/>... ...
In the years and decades to come,
HTML https://soberthinking.createaforum.com/gallery/soberthinking/1-040622202719-14071062.gif<br
/>Peabody would become a huge industrial player in 😈
organised climate change denial – buying perhaps much more time
than Jones had ever envisaged. ... ...
Of course, while the rediscovery of the 1966 journal is
important – given it reveals the coal industry understood the
climate change implications of burning fossil fuels, even so
long ago – the truth is, by that point, those dangers were no
secret.
The year before, in 1965, a US science advisory committee
advised president Lyndon Johnson of the global warming processes
underway due to fossil fuels being burned.
"Man is unwittingly conducting a vast geophysical experiment.
Within a few generations he is burning the fossil fuels that
slowly accumulated in the earth over the past 500 million
years," the report said.
"The climatic changes that may be produced by the increased CO2
content could be deleterious from the point of view of human
beings."
Even then this was old news. The dangers of climate change
literally made the front pages of newspapers as [b]far back as
1912 –
HTML https://www.sciencealert.com/a-newspaper-from-1912-predicted-the-future-consequences-of-burning-coal<br
/>more than 100 years ago [/b] :o – and was written about even
in
the popular press as far back as the mid-19th century.

"🐍 [shadow=red,left]Corporations[/shadow] should not be

/>Horner recently published a paper in the Environmental Law
Reporter
HTML https://www.elr.info/articles/elr-articles/does-first-amendment-protect-fossil-fuel-companies-public-speech<br
/>(hosted free on Horner's LinkedIn) that examines Big Oil's
free
speech defense, and she did not find it convincing!
Horner explains that, just like the[shadow=red, left] tobacco
companies[/shadow] before them, who "were made to account for
their actions following the disclosure of internal documents
chronicling the scheme to deceive the public," fossil fuel
companies "have followed suit, arguing their public statements
are protected by the First Amendment's freedom of speech and
right to petition clauses."
Horner’s richly cited, 35-page paper "seeks to determine whether
their argument holds any water" and finds that for the most
part, it does not.
It's not just that incorrect statements aren't protected speech,
though. To justify government intervention, the Supreme Court
precedent is that the speech must also present a "legally
cognizable harm," like in cases of fraud or defamation. Clearly,
climate disinformation rises to that level of harm.
Horner traces the history of the Supreme Court's commercial
speech decisions, outlining the various legal tests for whether
or not commercial speech is protected by the First Amendment,
and applies these tests to the fossil fuel industry's
communications.
She ultimately determines that most of Big Oil's public
communications on climate consist of false advertisements that
aren't protected by the First Amendment. (The exception is
"speech specifically directed to legislative or executive
action," because companies are still allowed to petition the
government.)
But corporate advertisements "should be classified as false and
misleading commercial speech that does not warrant First
Amendment protection" and they "should not be
[glow=green,2,300]rewarded[/glow] for the 😈
[glow=red,2,300]skill[/glow] with which they
[glow=red,2,300]distort[/glow] the truth and

/>Fossil Fuel Companies For [glow=red,2,300]Damages From Global
Heating[/glow][/center]
SNIPPETS:
Puerto Rico filed suit against fossil fuel companies this week,
The Verge reports. The complaint claims those companies misled
the public about climate change and delayed a transition to
clean energy. The suit seeks $1 billion in damages to help
Puerto Rico defend itself against climate disasters. In a
complaint filed in San Juan yesterday, the Puerto Rico
Department of Justice said the companies violated trade law by
promoting fossil fuels without adequately warning about the
dangers. The defendants include ExxonMobil, BP, Chevron, Shell,
ConocoPhillips, and other energy companies.
It’s the latest in a slew of lawsuits attempting to hold fossil
fuel companies accountable for the consequences of climate
change. Greenhouse gas emissions from fossil fuels are
supercharging storms and other extreme weather events while
rising seas eat away at island shorelines. Fossil fuel companies
have known for decades that their products would cause global
warming from research done by their own scientists and went
ahead doing business as usual anyway.
In the complaint, Puerto Rico says it expects to pay billions of
dollars in the future to cope with catastrophes made worse by
climate change — including storms like Hurricane Maria, which
killed thousands of people in 2017 and triggered power outages
that lasted for months in some cases.
The suit asks defendants to contribute to a fund that would be
used to mitigate the consequences of climate change and pay for
measures to strengthen Puerto Rico’s infrastructure against
future climate-related calamities. Thirty seven municipalities
in Puerto Rico and the capital city of San Juan have previously
filed suit against fossil fuel companies, seeking to hold them
accountable

“It’s more important than ever for officials to stand up to the
fossil fuel industry on behalf of their communities. The people
of Puerto Rico deserve their day in court to hold Big Oil
accountable,” Richard Wiles, president of the Center for Climate
Integrity that tracks climate cases and provides legal support,
said in an emailed statement. ... ...
The lawsuit alleges that, to this day, the

/>while failing to acknowledge that consumption of their
products
is a [glow=maroon,2,300]primary[/glow]
[glow=red,2,300]driver[/glow] of climate change. In addition to

This suit also seeks to compel the defendants to contribute to
an equitable fund to mitigate the ongoing damages to Puerto Rico
and strengthen public infrastructure against sea level rise and
storm damage, restore natural resources, fund local climate
resilience measures, and rebuild natural barriers to protect
communities from sea level rise and climate-influenced
atmospheric phenomena. The lawsuit arose after a study conducted
by the Puerto Rico Climate Change Council in 2022. It is based
on the Environmental Public Policy Act, the Puerto Rico
Antitrust Act, the Civil Code of 2020, and the Code of Civil
Procedure.
😬 Good Luck, Puerto Rico
