Letter to Board and Attorney Pilicy

Good afternoon everyone. I have received a letter via email
from a concerned neighbor who is experiencing difficulty
obtaining cooperation from the board and receiving the
runaround. The letters contents are below and was mailed via
certified mail.

Dear Franklin G. Pilicy:
My wife and I are long-time residents of the Ridgeview Terrace
Condominium Complex, I am writing to express my concern and
dispute the amount of our monthly homeowners associations cost
including arrearages. Upon purchasing our unit in January of
2007, we did not receive any documents pertaining to the
association other than the condominium law book that we
currently possess. We were under the impression that everyone
paid the same amount on a monthly basis so we asked a neighbor
what the cost were. The amount of 424.00 per month was given so
we immediately started paying that amount. In 2010 it was
brought to our attention that our assumption was incorrect. In
fact, everyone that resides here pays a different amount per
month. We then referred to our book of bylaws to see what our
specific amount was. To our surprise it was 261.39 per month.
We have lived here for six years and eleven months to date.
With that being said, there have been, or at least we weren’t
notified, any meetings to discuss the annual budget or increases
in condominium fees. Two items that require a vote after owners
have reviewed the proposal per the law. For the past three
years we have attempted to resolve the issue with the last time
occurring on during this year’s elections in October 2013. The
board verbally assured me that the issue would be resolved and I
could expect a telephone call within a few days. This is the
third time this has occurred and we’ve had enough. It is
apparent that civility is non-existent so we are left without
any other options.
We would respectfully request the following:
1. To receive an account statement on a monthly basis delivered
by mail
2. A certified copy of the most recent financial audit
3. A copy of all budgets passed for the past 6 years with the
approved minutes from the meetings per CGS 47-261e
4. A certificate or memoranda of insurance including fidelity
insurance as required by CGS Sec. 47-255g
5. Detailed records pertaining to the associations reserve
account per Public Act 13-289
6. To receive meeting agendas via mail 48 hours prior to
meetings per Public Act 13-289
7. A copy of all approved minutes for the past six years in re
association monthly increases
It is unfortunate that the board of directors are as overwhelmed
as they are don’t seek the assistance that they need. My wife
and I are using the only document that we received from the
association that lists a monetary amount as record unless and
until we receive documentation that reflects approved increases
between January 2006 and the present. Items one through seven
above will suffice and hopefully allow us to get back to our
normal lives. Thank you for your cooperation in this matter.
I have asked my neighbor to keep me posted so that I can keep
you all posted.

I have the formula to calulate each unit fee. Each unit has a
ratio based on sqft. For instance your unit is the 2nd highest
of your building behind 214a.
Tell me which unit and I'll give you the ratio. Your ratio is
0.708372
From the top of my head, the way it is calculated is as follows:
Total condo fee yearly income / Total number of units = average
fee per unit per year.
Then you multiply that average to adjust for sqft and you get
the monthly fee.
I have the sqft ratio for each unit.
The best is to ask the bookeeper the numbers used to calculate
the condo fee. Someone has to know since it is calculated and
charged! if you know the total base amount, a spreadsheet can be
posted to show each unit fee.
That information MUST be in the bylaw. It used to be in it. It
must be public to all owners to see.
