       freelance reporter in San Francisco, awoke Friday to the sounds
       of someone trying to break into his house.</p>&#13;<p
       data-elm-loc="2">About 10 officers from the San Francisco Police
       Department were bashing the front gate of his home in the Outer
       Richmond neighborhood with a sledgehammer, he said. It was just
       after 8 o&rsquo;clock in the morning.</p>&#13;<p
       data-elm-loc="3">Carmody called out and said he would let them
       into the house. The officers showed him a search warrant and
       proceeded to go through his home &mdash; from &ldquo;top to
       bottom&rdquo; he says &mdash; with their guns drawn.</p>&#13;<p
       data-elm-loc="4">&ldquo;They treated me like I was some kind of
       drug dealer," he said in an interview with The Washington
       Post.</p>&#13;<p data-elm-loc="5">Carmody was being raided in
       connection with a criminal investigation.</p>&#13;<p
       data-elm-loc="6">Two weeks before, police investigators showed
       up at his home to ask him, politely he says, to identify the
       source who provided him with a confidential police report about
       the February death of the city&rsquo;s public defender, Jeff
       Adachi. Carmody, who said he worked with three local television
       news stations on the story, declined.</p>&#13;<p
       data-elm-loc="7">He wasn&rsquo;t about to give up his source on
       Friday either, despite the escalation &mdash; not to the police
       or two FBI agents in suits who questioned him about the case, he
       said.</p>&#13;<p data-elm-loc="8">&ldquo;I&rsquo;m smart enough
       not to talk to federal agents, ever,&rdquo; Carmody said.
       &ldquo;I just kept saying &lsquo;lawyer, lawyer, lawyer.'
       &rdquo;</p>&#13;<p data-elm-loc="9">So he stayed handcuffed for
       the next six hours, he says &mdash; a certificate of release
       from the police department that he distributed says he was in
       custody from 8:22 a.m. until 1:55 p.m. &mdash; as investigators
       searched his home, then his office, where they found the report
       in a safe. A search warrant filed in the case notes that it was
       issued as police investigated &ldquo;stolen or embezzled
       property.&rdquo;</p>&#13;<p
       data-elm-loc="10">&ldquo;There&rsquo;s only two people on this
       planet who know who leaked this report &mdash; me and the guy
       who leaked it,&rdquo; Carmody said.</p>&#13;<p
       data-elm-loc="11">The raid on Carmody&rsquo;s home and office
       drew wide First Amendment-related attention in the Bay Area over
       the weekend. And it added a new twist to the intrigue that
       surrounded the death of Adachi, who had built up a high profile
       as a public defender in the <a
       href="
  HTML https://web.archive.org/web/20030612012020/http://asianweek.com/2003_01_10/bay_adachi.html"<br
       />target="_blank" rel="noopener">16 years</a> he had held the
       office.</p>&#13;<p data-elm-loc="12">The only elected public
       defender in California, Adachi was <a
       href="
  HTML https://www.sfchronicle.com/bayarea/article/Public-Defender-Jeff-Adachi-dies-13638785.php?psid=42XPW#photo-16972298"<br
       />target="_blank" rel="noopener">known </a>as an watchdog on
       police misconduct. His death, on Feb. 22, at the age of 59, was
       attributed in early reports to a heart attack.</p>&#13;<p
       data-elm-loc="13">Then more information came to
       light.</p>&#13;<p data-elm-loc="14">On Feb. 24, ABC 7 <a
       href="
  HTML https://abc7news.com/abc7-obtains-sfpd-report-on-jeff-adachi-death/5153863/"<br
       />target="_blank" rel="noopener">published a story</a> after it
       said it obtained a police report and photos about Adachi&rsquo;s
       death, which included unflattering details about the public
       defender&rsquo;s last hours. The story reported that he had been
       with a woman named Caterina &mdash; not his wife &mdash; and
       that he was found unresponsive in an apartment with &ldquo;an
       unmade bed, empty bottles of alcohol, cannabis gummies, and two
       syringes that may have been left by
       paramedics.&rdquo;</p>&#13;<p data-elm-loc="15">The publication
       of those details, which did little to illuminate the nature of
       Adachi&rsquo;s death and more to call into question his
       character, prompted some to wonder if the police department was
       retaliating against Adachi, even after his death.</p>&#13;<p
       data-elm-loc="16">&ldquo;It&rsquo;s curious that we&rsquo;re
       reading leaked details about another &lsquo;woman,&rsquo; the
       renting of an apartment, and entirely unnecessary mentions of
       alcohol, cannabis, and syringes,&rdquo; SFist <a
       href="

       &ldquo;Certainly the incident ought to be investigated, as any
       death should, but the information coming out makes it seem like
       Adachi&rsquo;s decades-old battles with law enforcement &mdash;
       on behalf of defendants and otherwise &mdash; may continue even
       after his passing.&rdquo;</p>&#13;<p

       editor of the San Francisco news site 48 Hills, called the local
       coverage &ldquo;repugnant,&rdquo; noting how disliked Adachi was
       by many police officers in the city in a post <a
       href="

       />target="_blank" rel="noopener">he wrote at the
       time</a>.</p>&#13;<p data-elm-loc="19">&ldquo;Where do you
       supposed those came from? Why do you suppose they wound up with
       the sensation-driven TV stations?&rdquo; he wrote of the
       provenance of the police report. &ldquo;The photos have been
       widely publicized with no context at all. There are photos of
       &lsquo;an unmade bed&rsquo; &mdash; a salacious innuendo with no
       relevance.&rdquo;</p>&#13;<p data-elm-loc="20">Carmody declined
       to give specifics about the three outlets he had worked with on
       the story.</p>&#13;<p data-elm-loc="21">A &ldquo;stringer&rdquo;
       in the parlance of TV news, Carmody occupies the small niche in
       the world of broadcast journalism that was satirized in the
       Hollywood film &ldquo;Nightcrawler.&rdquo;</p>&#13;<p
       data-elm-loc="22">He works every night from about 10 p.m. to 6
       a.m., when he chases news, such as car crashes, crime scenes,
       disasters, weather stories, the release of a new video game
       &mdash; &ldquo;anything that happens overnight,&rdquo; he says
       &mdash; then sells his services and materials he gathers to
       local stations for their morning broadcasts. His name is rarely
       included on the report or corresponding material, he
       said.</p>&#13;<p data-elm-loc="23">His company, North Bay
       Television, which is run out of an office downtown stocked with
       police scanners, computers, and a coffee machine, employs three
       or four other people, down from a onetime peak of 10.</p>&#13;<p
       data-elm-loc="24">&ldquo;Like all media, we are shrinking," he
       said.</p>&#13;<p data-elm-loc="25">He said he has never paid any
       of his sources of information or material.</p>&#13;<p
       data-elm-loc="26">Asked about tensions between the police
       department and Adachi, Carmody declined to comment on the
       politics of the case.</p>&#13;<p data-elm-loc="27">&ldquo;I had
       no beef with him, I had no beef with anyone, I&rsquo;m just a
       journalist in the middle of this,&rdquo; he said.</p>&#13;<p
       data-elm-loc="28">He said he believed he was being targeted
       because he was a freelancer, noting that details in the police
       report had appeared in other publications, such as<a
       href="

       />target="_blank" rel="noopener"> the San Francisco
       Chronicle</a>.</p>&#13;<p data-elm-loc="29">&ldquo;I don&rsquo;t
       think there was a police raid at the Chronicle with a
       sledgehammer yesterday,&rdquo; he said.</p>&#13;<p
       data-elm-loc="30">A medical examiner&rsquo;s report, which was
       released to the media in March, filled in more details about
       Adachi&rsquo;s death. The office <a
       href="
  HTML https://www.sfgate.com/bayarea/article/SF-Public-Defender-Jeff-Adachi-died-accidental-13710124.php"<br
       />target="_blank" rel="noopener">ruled his death an accident</a>
       due to the effects of cocaine and alcohol combined with a
       preexisting heart condition it said Adachi had.</p>&#13;<p
       data-elm-loc="31">The San Francisco Police Department defended
       the investigation Saturday in a statement sent to <a
       href="
  HTML https://twitter.com/SonjaHutson/status/1127270157108142080"<br
       />target="_blank" rel="noopener">local reporters</a>.</p>&#13;<p
       data-elm-loc="32">&ldquo;The citizens and leaders of the City of
       San Francisco have demanded a complete and thorough
       investigation into this leak, and this action represents a step
       in the process of investigating a potential case of obstruction
       of justice along with the illegal distribution of confidential
       police material," it said.</p>&#13;<p data-elm-loc="33">An FBI
       spokeswoman said that the bureau&rsquo;s agents did not
       participate in the execution of the search warrant but confirmed
       that they were present to interview Carmody.</p>&#13;<p
       data-elm-loc="34">A law enforcement source, who spoke on the
       condition of anonymity, said that Carmody was handcuffed for
       procedural issues related to &ldquo;multiple weapons&rdquo; in
       the house. Carmody said that he is the lawful owner of an
       unspecified number of guns.</p>&#13;<p data-elm-loc="35">Carmody
       says his ability to work is now crippled by the seizure of his
       electronics. A search warrant and affidavit he distributed noted
       that police took at least at least four tablets, seven
       computers, 10 hard drives, a dozen phones, two cameras,
       reporters&rsquo; notebooks and a thumb drive from his home. He
       has <a
       href="
  HTML https://www.gofundme.com/journalist-raided-by-police-support-1st-amendment"<br
       />target="_blank" rel="noopener">started a GoFundMe </a>page to
       raise money to buy more equipment.</p>&#13;<p
       data-elm-loc="36">Thomas R. Burke, a First Amendment lawyer in
       the Bay Area who represents Carmody, said that he believes the
       police overreached significantly.</p>&#13;<p
       data-elm-loc="37">&ldquo;The appropriate thing was to issue a
       subpoena, not a search warrant,&rdquo; he said, noting the
       breadth of Carmody&rsquo;s material they had control over in all
       of this devices and notebooks. He said he wants to know whether
       the judges who signed the warrants were aware that they were for
       a reporter&rsquo;s home and office.</p>&#13;<p
       data-elm-loc="38">Carmody said he had never been pressured by
       law enforcement to give up a source before in 29 years of
       reporting &mdash; mentioning as an example the leaked
       photographs from San Francisco&rsquo;s public transportation
       agency he recently acquired that exposed a safety issue with

       how far this has gone already,&rdquo; he said. &ldquo;It&rsquo;s

       Elizabeth Anderson wrote a chapter for The Oxford Handbook of
       Freedom and Equality, titled simply Freedom and Equality. She
       begins by acknowledging that perfect material equality would
       require an authoritarian state, and no one seriously argues for
       that position. On the other hand, Friedrich Hayek argued in The
       Road To Serfdom that any form of socialism would lead down the
       slippery slope to totalitarianism, but he was wrong. There are
       realistic choices short of perfect material equality, such as
       the societies of Western Europe with their social democratic
       forms of government and economy.
       Anderson writes:

       tank is the Cato Institute, which is heavily funded by the
       Charles Koch Foundation, another group not that interested in
       broad concepts of freedom. So I’m not going to use the term, and
       instead will refer to it as freedom from dominanation, or
       non-domination.

       them. Live on Fox News, Graham escalated Trump's attacks calling
       the four congressional representatives—all women of
       color—“communists.”

       The Real News Network's Marc Steiner spoke to Dr. Kimberly
       Moffitt, an Associate Professor of the Language, Literacy and
       Culture PhD program and the American Studies department at the
       University Of Maryland Baltimore County, and Dr. Gerald Horne,
       John J. And Rebecca Moores Chair of History and African-American
       Studies at the University of Houston about ongoing and
       escalating racist rhetoric by the president and the GOP.
       Moffitt observed that there is still a debate about whether
       Trump's comments are noteworthy—clearly an indication that
       racism remains an issue in the U.S.
       “It's even a denial about the role of race in our society as a
       whole that we don't even believe this is something that we
       should be focused on because of what Trump is contributing to
       us, and what many believe is a very strong economy and a
       willingness to say the things that haven't been said by previous
       administrations regarding our borders and our trade deals—all
       that many have felt like had been a bad deal for America,”
       Moffitt said. “I also see this very much as about a browning of
       America that really frightens a lot of that 63 million that
       support President Trump. A lot of folks are struggling with the
       idea that these very vocal voices. The progressives of our House
       currently happen to be women, but they are also brown women, and
       that becomes offensive to a white male that says there is a
       place for all of us and they aren't maintaining the place that
       they're supposed to in our society.”
       Horne explained that Trump's attacks have been facilitated by
       the Democratic Party's leaders, such as Nancy Pelosi, in much
       the same way that the Democrats facilitated Trump's presidential
       victory.
       “In some ways the Democratic Party—at least some elements within
       the leadership—paved the way for the rise of one Donald J.
       Trump. I take it that your audience has been paying attention to
       the New York Times for the past few days,” Horne said. “And then
       if you look at the origins of this controversy that has brought
       us to your cameras today, in many ways it starts with an
       interview that Speaker Nancy Pelosi did with New York Times
       columnist Maureen Dowd when she sharply rebuked, reprimanded,
       and criticized Congresswoman Ocasio-Cortez in particular—a
       congresswoman who has been receiving a steady rain of death
       threats—and that opened up Congresswoman Ocasio-Cortez to be
       receiving even more death threats. She of course clapped back.
       Speaker Pelosi, rather than taking the high road, then upped the
       ante and opened the door for Donald J. Trump to enter into this
       debate. And so once again you see leading Democrats paving the
       way for the rise of Donald J. Trump's racism."

       While the vote on H.Res.489, Condemning President Trump's racist
       comments directed at Members of Congress, was almost entirely
       partisan, four Republicans broke ranks to support it. They were:
       Rep. Susan W. Brooks (R-Indiana); Rep. Brian Fitzpatrick
       (R-Pennsylvania); Rep. Will Hurd (R-Texas), who addressed the
       National Congress of American Indians for the first time earlier
       this year; and Rep. Fred Upton (R-Michigan).
       Amash, who was among a core group of lawmakers who have been
       voting against Indian Country legislation in the 116th Congress,
       also voted in support of the rebuke resolution.
       Trump's remarks about the minority women in Congress represent
       the latest in a long line of remarks deemed racist, offensive
       and riddled with stereotypes. During his days as a commercial
       casino operator, he frequently targeted tribes using racially
       charged language.
       In reference to the Mashantucket Pequot Tribal Nation, the
       owners of what was the largest casino in the world at the time,
       Trump famously told Congress in October 1993: "Now, they don't
       look like Indians to me."
       Such comments, along with others that questioned the legitimacy
       of tribal nations as well as the integrity of the overall Indian
       gaming industry, motivated the late Native rights activist Frank
       LaMere, a longtime Democratic figure, to oppose Trump during the
       2016 presidential campaign, and he urged Native voters to do the
       same.
       "We need to stand up to this bully," LaMere, who was a citizen
       of the Winnebago Tribe, told Indianz.Com during the Democratic
       National Convention in Philadelphia that summer.
       Since taking office in January 2017, Trump has repeatedly used
       the name of a Native woman, Pocahontas, as a slur against Sen.
       Elizabeth Warren (D-Massachusetts), one of his biggest political
       rivals. The most glaring incident took place in front of Native
       war heroes during Native American Heritage Month later that
       year.
       "That's telling of him and his administration that they are not
       working in any way to build relationships with Indian tribes,"
       Haaland told Indianz.Com at the time. A year later, she won her
       seat in Congress, making history along Davids as the first two
       tribally-enrolled women on Capitol Hill.

       Whereas the Founders conceived America as a haven of refuge for
       people fleeing from religious and political persecution, and
       Thomas Jefferson, Alexander Hamilton, and James Madison all
       emphasized that the Nation gained as it attracted new people in
       search of freedom and livelihood for their families;
       Whereas the Declaration of Independence defined America as a
       covenant based on equality, the unalienable Rights of life,
       liberty and the pursuit of happiness, and government by the
       consent of the people;
       Whereas Benjamin Franklin said at the Constitutional convention,
       “When foreigners after looking about for some other Country in
       which they can obtain more happiness, give a preference to ours,
       it is a proof of attachment which ought to excite our confidence
       and affection”;
       Whereas President Franklin D. Roosevelt said, “Remember,
       remember always, that all of us, and you and I especially, are
       descended from immigrants and revolutionists”;
       Whereas immigration of people from all over the Earth has
       defined every stage of American history and propelled our
       social, economic, political, scientific, cultural, artistic, and
       technological progress as a people, and all Americans, except
       for the descendants of Native people and enslaved African
       Americans, are immigrants or descendants of immigrants;
       Whereas the commitment to immigration and asylum has been not a
       partisan cause but a powerful national value that has infused
       the work of many Presidents;
       Whereas American patriotism is defined not by race or ethnicity
       but by devotion to the Constitutional ideals of equality,
       liberty, inclusion, and democracy and by service to our
       communities and struggle for the common good;
       Whereas President John F. Kennedy, whose family came to the
       United States from Ireland, stated in his 1958 book “A Nation of
       Immigrants” that “The contribution of immigrants can be seen in
       every aspect of our national life. We see it in religion, in
       politics, in business, in the arts, in education, even in
       athletics and entertainment. There is no part of our nation that
       has not been touched by our immigrant background. Everywhere
       immigrants have enriched and strengthened the fabric of American
       life.”;
       Whereas President Ronald Reagan in his last speech as President
       conveyed “An observation about a country which I love”;
       Whereas as President Reagan observed, the torch of Lady Liberty
       symbolizes our freedom and represents our heritage, the compact
       with our parents, our grandparents, and our ancestors, and it is
       the Statue of Liberty and its values that give us our great and
       special place in the world;
       Whereas other countries may seek to compete with us, but in one
       vital area, as “a beacon of freedom and opportunity that draws
       the people of the world, no country on Earth comes close”;
       Whereas it is the great life force of “each generation of new
       Americans that guarantees that America's triumph shall continue
       unsurpassed” through the 21st century and beyond and is part of
       the “magical, intoxicating power of America”;
       Whereas this is “one of the most important sources of America's
       greatness: we lead the world because, unique among nations, we
       draw our people -- our strength -- from every country and every
       corner of the world, and by doing so we continuously renew and
       enrich our nation”;
       Whereas “thanks to each wave of new arrivals to this land of
       opportunity, we're a nation forever young, forever bursting with
       energy and new ideas, and always on the cutting edge”, always
       leading the world to the next frontier;
       Whereas this openness is vital to our future as a Nation, and

       seeking refuge and asylum from violence and oppression, and
       those who are willing to work hard to live the American Dream,
       no matter their race, ethnicity, faith, or country of origin;

       (3) strongly condemns President Donald Trump’s racist comments
       that have legitimized and increased fear and hatred of new
       Americans and people of color by saying that our fellow
       Americans who are immigrants, and those who may look to the
       President like immigrants, should “go back” to other countries,
       by referring to immigrants and asylum seekers as “invaders,” and
       by saying that Members of Congress who are immigrants (or those
       of our colleagues who are wrongly assumed to be immigrants) do
       not belong in Congress or in the United States of America.
