       Insurance fun
By: Dan Breen Date: October 6, 2014, 2:28 am
       ---------------------------------------------------------
When I first joined I did the rounds of reading through various
       threads and saw This one
  HTML http://ollr.createaforum.com/general-land-rover-stuff/pinched-series-3/msg88471/#msg88471<br
       />and in particular Fuckwit's post.
For my sins, I work in insurance, and recently have had to go
through a few qualifications, one of which covered some of the
laws covering insurance and what you can and can't get away
       with.
Consumer Insurance (Disclosures & Representations) Act
       2012.(apologies, it's very dull reading)
  HTML http://www.legislation.gov.uk/ukpga/2012/6/contents/enacted.
If you ever need to claim, this piece of legislation is your
freind. The biggest thing most companies will try and do is find
an excuse not to pay out, often on the grounds of a
non-disclosure or misrepresentation. The above act specifies
what qualifies for them to be able to do that but the short
       version is:
If a non-disclosure is deliberate, (not telling), or reckless,
(don't care). If a non-disclosure is fraudulent, it is always
       treated as deliberate.
If a non-disclosure or misrepresentation is accidental, like an
old speeding conviction that's no longer on your licence and is
nearly 5 years old, or that you forgot your landy is registered
to your company instead of you, (and then correct that as soon
as you find out), then it CANNOT be used to deny a claim or void
       the policy.
So, I let Fuckwit know this, double checked a few things with
the relevant team at work, and gave him the good news.
He got some better news back though:
       Paid out, (minus his excess)
       Voidance removed.
Took a year but was worth it.
So, if any of you have insurance questions, let me know, if I
       can answer them, I will.
       And sorry about the Meercats.

It must be said young Dan saw me right. The b*stards were happy
to bamboozle me out of making any payment. Lancaster it was,
via their insurer Allianz. Had I cashed the premium cheque they
sent by way of voiding my policy I would likely have been
scuppered, but a little voice inside told me to sit tight, and
then Dan tipped me a nod, and I reopened the claim. Only got
paid last month for a calim form June last year. It will never
repalce my 109, the thing had a small fortune spent on it but at
least I got just about half of waht it would cost to build
       anotehr.
Dan as I said, you're owed a drink.

Glad to see the good news! :)
On a related note (apologies for the thread hijack), a friend of
mine has recently set up an insurance company specifically for
enthusiast-owned 4x4s. They stipulate that vehicles much have a)
at least one significant modification and b) must be used
off-road. This weeds out the Cheshire set and thus keeps
premiums low. being a small family-run company, they wont fuck
you about like a big company either.
Should be ideal for the majority of people on here!

Well done Dan! Thanks for taking the time to help, insurance is
not my area of expertise and the original refusal did seem
really harsh. Good news Mr Fuckwit, now can you get on and
finish your definitive brake post pretty please?
       Cheers Mud
