WP Vs Sparta.
By: West Phoenicia Date: August 16, 2015, 12:20 am
---------------------------------------------------------
Sophia Cinnethopia a Judge in the West Phoenician Supreme Court
and Lawyer for 20 years wishes to file a compaint against the
Nation of Sparta that we would like the Supreme Court of the
NCSA to hear and act on.
Issue of Complaint:
Sparta who proclaims to fight for the Constitution has launched
an attack on West Phoenician sovereignty. We evoke Section IV
clause 7 and ask the Court to condemn the action of Sparta.
We also file that Sparta has committed a war crime by bombing a
Hospital Ship and attacking civillians.
We ask for the maximum penalties the Supreme Court will allow.

I'd love to point out something:
You don't need a casus beli to declare war. He can invade you
for no damn reason. What he DOES need it for is this:
Retaliation.
If he doesn't have a reason, then it'd be like Germany invading
Poland. Why? Is there a reason? No.

I am here your Honors, I apologize for the wait. I will be
Sparta's legal counsel during this case.
Your Honors, I would like to motion that this case be dismissed
on the basis the West Phonecian Prosecution has failed to state
a claim and as such a cause of action. Your Honors, we would
like to point out that Section IV Clause VII is irrelevant to
the allegations made at my client. We would also like to point
out that the Constitution nor any law as of late has set out
guidelines or the rules for war.
Thank you Your Honors

The mentioned section of the constitution does seem to be
irrelevant for this case.
Atacking a fellow state of the NCSA does, nevertheless go
against the heart of the constitution.
I expect the gentleman from West Phoenicia to make a better case
for his complaint. Should he do so, we shall consider penalties.
Until then, no measures will be taken against the Spartan state

No measures CAN be taken. We are here to uphold laws, not deal
out a slap every time someone does something against the spirit
of the constitution, or does something another state doesn't
like. There were no laws against what he did. As such, since he
did not BREAK any laws, we cannot give him a punishment.

OOC: Diddy are you a judge? If so, I made my motion and it would
be unfair for the defense if WP were able to change their
charges when a motion is to be considered.

That's not completely correct.
Article I, Section 2:
The purpose of this constitution shall be to better secure and
perpetuate mutual friendship and intercourse among the different
states party to this union.
Anyways, I agree with you, that no penalties should be taken.
But I wanted to give WP a chance to make a better case.
Maybe he has something up his sleeve, you know?
As I said, for now, no penalties.

That is the PURPOSE, but because there is no real law, you
cannot punish him for it. He has no case.

Ok.
Do all members of the Supreme court then agree that WPs case
should be dismissed?
(OOC: Yes, I was made Chief Justice yesterday, much to my
surprise. So, sorry if I'm not perfect right away. I try to
improve every day.)

The Chief Justice may want to reexamine the Constitution Article
VI Section 7. WP has a right to form a government of their
choosing. Sparta reason for invasion also consist of forcing a
government to change. Sophia Cinnethopia points out. "We have
received no such protection.
If it pleases the court. The nation of USSDEN is not apart of
this trial and thus should be made to refrain from commenting
and their posts stricken.."
