Insurance company taking the piss
DIR By: Dazzz

A few months ago a van smashed into our front garden through a
wall and bushes etc. Since then, we've been dealing with their
insurance company. They keep stalling or they say the quotes we
have are too high £2600 ish( despite both independent quotes
being within £20 of eachother) The insurance company haven't
even seen the damage or the work that needs doing.
Is there anything I can do to get them to pay out? I dont wanna
go to a solicitor if its going to cost me money.

Yep, If your insurer hasn't resolved your complaint within eight
weeks, or has rejected it, you can take it to the Financial
Ombudsman Service (FOS). FOS has the power to award up to
£150,000 against an insurance company. Now, this is for your
own insurance company, but I am fairly certain the 3rd party
insurance should be on the case. Do you have any legal cover
for your own policy?? failing this, speak to the citizens
advice..

Someone drove into a mate of mine and wrote it off, so his
company contacted the 3rd parties insurance, the 3rd part
offered at least 40% less than the respected value. They
rejected the offers until something came up that was close. The
car was probably the best example that you could get, with full
dealer service history.

+1 for the Financial Ombudsman, they really do get things done.
On your next communication with the Insurance Company, tell them
you are writing to them (the Financial Obudsman), this in itself
might shake some life into them.
We had a huge issue with my wife's credit record, where one
comany of idiots mistraced the debt someone with a similar name
to her maiden name, and this led to a chain reaction that saw
seemingly the entire financial world round on her! Talking
any/all of them was like talking to a brick wall, 90% of them
refused to help, but even the odd one that did try, ..it was
like a bizarre puzzle, which, if unpicked in the wrong order,
would simply re-jumble itself almost instantly.
We ended up writing to our MP out of desperation, who passed on
our complaint to the FO, it was then resolved, completely,
within weeks.

Just checked, I do have legal cover. The citizens advive website
only has advice for your own insurance company. That say to go
through the company's complaints procedure, then The FOS. But
the company we're dealing with is one that weve been passed down
to from one company to another called 'core claims'
Will speaking to my home insurance effect future insurance
prices?

With legal cover you should have access to someone who can work
on your behalf, but I have no experience with this, just
comparing this to car insurance. Ideally you want them to chase
the third party. Hope it gets sorted soon.

Yes that's right. Speak to your insurer and tell them you want
to claim. They will then pressure the third party under
subrigation which is part of English common law. That is
providing you are in England or Wales. They are likely to pay
out your claim and then just get the money back from the third
party and they have a bit more bargaining power than you do.
