Summary of incident
On April 28, 2004 in Tarrant County, Carter and his codefendant
entered the residence of an eighty nine year old white male,
bound him at the hands and feet and beat him to death. Carter
and codefendant then stole approximately $6,000 from the
victim's home.

Texas Prepares for Execution of Tilon Carter on February 7,
2017--
Monday, January 30, 2017
Tilon Lashon Carter is scheduled to be executed at 6 pm CST, on
Tuesday, February 7, 2017, at the Walls Unit in the Huntsville
State Penitentiary in Huntsville, Texas. Thirty-seven-year-old
Tilon is convicted of the robbery and murder of 89-year-old
James Eldon Tomlin in Tarrant County, Texas. Tilon has spent
the last 10 years of his life on Texas’ death row.
Tilon did not graduate from high school, dropping out after the
11th grade. He worked as an auto mechanic and a roofer. Tilon
was previously arrested for robbing a couple at gunpoint and
using the stolen money to pay off a drug debt. While in prison,
he led a riot. Tilon was also convicted of indecent exposure
and assault against his girlfriend.
On April 28, 2004, Tilon Carter and his 31-year-old girlfriend
Leketha Allen were discussing how they needed money. Allen’s
mother overheard them and suggested that they rob James Tomlin,
an elderly man who lived nearby and was known to keep large
quantities of cash in his house. Allen’s mother drove Carter
and Allen by James' house, specifically pointing it out.
Carter and Allen returned to James’ home the next day, forcing
their way inside after James opened the door. Cater bound
James’ hands and feet tightly with duct tape. Duct tape was
also placed over his mouth. Carter and Allen then searched
home, discovering approximately $6,000 in cash.
James was discovered the following day, lying face down in his
hallway. A medical examiner determined that he had been
severely beaten, and that the cause of death was asphyxiation.
The evidence indicated that James was likely smothered to death.
At his trial, Carter’s ex-girlfriend (not Allen) and a cell mate
testified that Carter had boasted about Allen and him killing an
old man during a robbery. Carter was convicted and sentenced to
death.
Leketha Allen was convicted and sentenced to 25 years in prison.
She becomes eligible for parole in 2017.

Texas Court of Criminal Appeals stays execution of Tilon
Carter--
February 3, 2017
The Texas Court of Criminal Appeals has granted a stay of
execution for Tilon Carter. Originally scheduled to be executed
on February 7, 2017, Carter has spent 11 years on death row for
the 2004 robbery and murder of 89-year-old James Eldon Tomlin in
Fort Worth. The court granted the stay because the trial court
missed the deadline to notify the Office of Capital and Forensic
Writs of Carter’s execution date.
According to the Texas Code of Criminal Procedure, if the trial
court fails to notify the convict’s lawyer and the Office of
Capital and Forensic Writs that an execution date was set within
two business days of setting it, the court must reset the
execution date. In Carter’s case, it took three days.
This marks the second stay of 2017 and the first from the Texas
Court of Criminal Appeals. Earlier this week, John Ramirez
received a last minute stay halting his February 2, 2017
execution. The State of Texas has put one person to death this
year. Although there are no other executions scheduled for the
remainder of February, there are five executions scheduled in
Texas through July.
