GALESBURG — After a temporary stay of execution, granted by the
U.S. Supreme Court in January, Galesburg native Richard Glossip
and two other inmates on Oklahoma’s death row are back on the
       schedule.
Glossip was convicted of first-degree murder in 1998 for his
involvement in the killing of his boss, Barry Van Treese, an
Oklahoma City motel owner. On Sept. 16, Glossip is scheduled to
die by the same injection that sent convicted murderer,
kidnapper and rapist Clayton Lockett into an agonizing,
       40-minute execution in April 2014.
On June 29, the U.S. Supreme Court held in a 5-4 decision that
midazolam, the drug used in Oklahoma’s three-part execution
****tail, did not violate inmates’ rights prohibiting cruel and
unusual punishment despite Lockett's agonizing death.
According to court documents, the state of Oklahoma alleged
Richard believed he was going to lose his job and offered Sneed
$10,000 to kill the owner of the Oklahoma City Best Budget Inn.
Justin Sneed was the actual killer but under Glossip's
       instructions.
In January 1997, Richard was managing the hotel under Van
Treese, the owner. Sneed was living at the motel rent free in
       exchange for maintenance work.
Van Treese’s wife testified in court that her husband discovered
some $6,100 in shortages at the motel following an audit and
believed Van Treese intended to ask Richard about the missing
       money.
Sneed said he had been confronted by Glossip, who appeared
“nervous and jittery,” in the early morning hours of Jan. 7,
1997. Sneed was asked to kill Van Treese for $10,000, an amount
that had grown each time Glossip asked him to do it in the past.
Using a master key given to him by Glossip, Sneed entered room
102 where Van Treese was sleeping and proceeded to bludgeon the
motel owner with a baseball bat.
In exchange for his testimony, Sneed was sentenced to life in
prison. Based solely on the convicted murder's testimony,
       Glossip was sentenced to death.

OK CITY - The Oklahoma County district attorney dismissed the
claims of a death row inmate's legal team Monday that there is
new evidence, calling the announcement a play for media
       attention.
"This is a bull---- public relations campaign," District
Attorney David Prater told reporters in a packed hallway at the
       state Capitol.
Prater's comments came just after a news conference held outside
the doors of the Oklahoma Supreme Court by a group of attorneys
and supporters of convicted murderer Richard Glossip.
His execution is scheduled for Wednesday.

OKLAHOMA CITY - Gov. Mary Fallin released the following
statement regarding a request by attorneys to delay the
       execution of Richard Glossip.

For months, and as part of a larger publicity campaign opposing
the death penalty, Richard Glossip’s attorneys have been
publicly claiming to have new evidence that exonerates their
client. During that time, my office and I have urged them to
bring that so-called evidence to the proper venue: a court of
law. Not only have Glossip’s lawyers not done so, but they have
actively rejected requests from public officials to examine
whatever materials they have. His attorneys even refused to
share the contact information of so-called ‘new witnesses’ with
Oklahoma County District Attorney David Prater and with my
       office.
Yesterday, forty-eight hours before Glossip’s scheduled
execution, his attorneys presented my office with a binder of
what they have labeled ‘new evidence.’ After reviewing it with
my legal team, we have determined the vast majority of the
limited content they have presented is not new; furthermore, we
find none of the material to be credible evidence of Richard
Glossip’s innocence. After carefully reviewing the facts of this
case multiple times, I see no reason to cast doubt on the guilty
verdict reached by the jury or to delay Glossip’s sentence of
death. For that reason I am rejecting his request for a stay of
       execution.
Nevertheless, I join our district attorney in urging Glossip’s
legal team to present whatever information they have to a court
of law. Courts, unlike my office, have the legal authority to
grant an indefinite stay of execution or a retrial. Courts are
the proper venue to present new information or evidence, and the
attorneys representing Glossip have a moral and ethical duty to
file legal documents and make their case in front of a judge.
In the event that a court refuses to issue a stay, Richard
Glossip will be executed soon. I hope the execution brings a
sense of closure and peace to the Van Treese family, who has
suffered greatly because of Glossip’s crimes.
Richard Glossip is scheduled to die Sept. 30 for the beating
death of Oklahoma City motel owner Barry Van Treese in 1997...

Court denies stay of execution for convicted killer Richard
       Glossip--
       September 28, 2015
MCALESTER, Okla. - A last ditch effort to halt Wednesday’s
execution of Richard Glossip was denied Monday.
The Oklahoma Court of Criminal Appeals denied Glossip’s request
for a stay of execution and a hearing to review new evidence
       presented by Glossip’s attorneys.
Glossip was convicted of murder for the 1997 death of motel
owner Barry Van Treese, though Glossip wasn’t the actual killer.
The man who bludgeoned Van Treese to death, Justin Sneed,
testified that Glossip hired him for the murder.
Sneed, who is serving a life sentence for the crime, testified
that Glossip paid him to carry out the murder.
Recently, Glossip’s legal team questioned Sneed’s credibility.
On Monday, the justices decided 3-2 against a stay.
Judges denying the stay wrote, "Glossip's 'new' evidence merely
expands on theories raised on direct appeal."
In the court’s opinion issued Monday, the Judge David Lewis
       wrote:
“After carefully reviewing Glossip’s subsequent application
for post-conviction relief, we conclude that he is not entitled
to relief. Accordingly, Glossip’s subsequent application for
post-conviction relief is denied. Further, Glossip’s motion for
an evidentiary hearing and motion for discovery is denied. Any
further request for a stay of execution is also denied.”
However, there were two judges who disagreed with the decision.
"Glossip's materials convince me that he is entitled to an
evidentiary hearing to investigate his claim of actual
innocence. I would reset Glossip's execution date 60 days from
now and order the completion of the evidentiary hearing within
30 days,” wrote Judge Arlene Johnson, who voted in favor of a
       stay of execution.
“Glossip claims to have newly discovered evidence that Sneed
recanted his story of Glossip’s involvement, and shared this
with other inmates and his daughter. While finality of judgment
is important, the State has no interest in executing an actually
innocent man,” wrote Presiding Judge Clancy Smith.
Those two votes were not enough for a stay, so now Glossip's
attorneys may either appeal in federal court or get an emergency
stay of execution from the U.S. Supreme Court.
Glossip’s execution is set for 3 p.m. Wednesday in McAlester.
