DeSantis signs death warrant in 1988 Florida r*p*, murder case--
James Phillip Barnes, 61, is scheduled to be executed Aug. 3 in
the murder of Patricia “Patsy” Miller, according to documents
posted Thursday.

BREVARD COUNTY, Fla. – A Brevard County man sentenced to death
for the 1988 murder of a woman whom he sexually battered has
finally received his execution date, according to state
officials.
On Thursday, state documents were filed to confirm the execution
date of Aug. 3 at 6 p.m. for James Phillip Barnes.
Court records show in 1988, Barnes broke into a woman’s condo in
Melbourne to r*p* and kill her.
He sexually battered her at knifepoint before tying her up,
beating her to death with a hammer and setting fire to the bed
her body was laid in to eliminate the evidence, the records
state.
Despite his attempts to burn the remains, forensic evidence
taken from the scene pointed toward Barnes being the killer in
1997. At that time, Barnes was already serving a life sentence
for the murder of his wife, Linda Barnes.
According to state records, Barnes wasn’t charged in the
Melbourne murder until 2007 after he admitted to the crimes in a
videotaped interview. Barnes was ultimately convicted and
sentenced to death for that murder on Dec. 13, 2007.
Despite an appeal in 2008 and a petition in 2010, Barnes’
conviction and death sentence have been affirmed by the Florida
Supreme Court.

Florida executes death row inmate James Barnes--
Florida executed Brevard County death row inmate James Barnes on
Thursday. His official time of death was 6:13 p.m.

Barnes did not give a final statement.
There were about 20 witnesses inside when the media were allowed
in to a white rectangular room facing a large glass window. At 6
p.m., the curtain over the window slowly opened and Barnes could
be seen laying on a gurney and covered by a white sheet. His
left arm was exposed with IV tubes and a brown strap attached.
At 6:01 p.m., Barnes elected not to give a final statement and
the execution process began. Three suited men with earpieces
observed him. At 6:12 p.m., a doctor emerged to check his vital
signs. Barnes was pronounced dead at 6:13 p.m.
The witnesses were silent and showed no reaction.
“James Barnes was a violent and ruthless criminal,” Melbourne
Police Chief David Gillespie said in an email after the
execution.
“And, while today's execution ensures he will never harm another
individual again, let us not forget the victims and the torture
they had endured. My heart goes out to the victims and their
families,” he said.
