Convicted Killer Of Wife And 2 Stepsons Loses Death Penalty

HOUSTON, Texas (AP) – Texas’ highest criminal court has refused
an appeal from a Dallas man sent to death row for fatally
stabbing his two stepsons during a 2007 attack that also killed
his wife.

40-year-old Robert Sparks contended a witness at the punishment
phase of his capital murder trial provided false testimony
regarding his prison classification if a jury chose life without
parole rather than a death sentence. Dallas County prosecutors
said the testimony was not incorrect.
The Texas Court of Criminal Appeals said Wednesday the appeal
fell short of legal requirements and dismissed it without
considering its merits.
Sparks was condemned for slayings where 9-year-old Harold Sublet
Junior was stabbed at least 45 times, 10-year-old Raekwon Agnew
was similarly stabbed and Sparks’ wife, Chare Agnew, died of 18
stab wounds.

A 45-year-old North Texas man who was convicted of murdering his
wife and 2 stepsons before raping his stepdaughter is set to be
put to death.
Robert Sparks, 45, is scheduled to be executed by lethal
injection Wednesday at the Huntsville “Walls” Unit.
Sparks, who has been on Texas death row since his conviction in
2008, is asking the U.S. Supreme Court to halt his execution,
arguing that the jury specifically relied upon “the false
testimony of prosecution expert A.P. Merillat when sentencing
him to death.
The appeal also claims that the courtroom bailiff wore a syringe
tie on the date of jury deliberations, “creating an unacceptable
risk of impermissible factors coming into play at trial.”
Court records show that just after midnight on Sept. 15, 2007,
Sparks put his hand over the mouth of his wife, Chare Agnew, and
stabbed her 18 times in her bed.
Then, one at a time, he woke up his stepsons — 9-year-old Harold
and 10-year-old Raekwon — and stabbed them 45 times each,
dragging their bodies into the living room and stashing them
under a comforter.
Next, he went after the girls, raping his 14-year-old
stepdaughter on the couch while her younger sister watched.
Afterward, he apologized to them for the rapes and murders — but
said their mother had been trying to poison him.
Sparks was arrested a few days later and tried the following
year.

raping, killing family--

A Texas inmate who claimed he had an intellectual disability in
a bid to avoid execution was given a lethal injection on
Wednesday, 12 years after admitting to fatally stabbing his wife
and two stepsons and raping his two stepdaughters.
Robert Sparks, 45, told investigators he killed his wife and 9-
and 10-year-old stepsons and raped his 12- and 14-year-old
stepdaughters because his family had been poisoning him and a
voice told him to kill his family. He asked to be tested for
poison, and for the two girls to undergo polygraph tests.
Sparks received a lethal injection at the state penitentiary in
Huntsville, Texas. He became the 16th inmate put to death this
year in the U.S. and the seventh in Texas. Seven more are
scheduled for execution this year in Texas, the country’s
busiest capital punishment state.
“I am sorry for the hard times. And what hurts me is that I hurt
y'all ... even y'all, too,” Sparks told family members who
watched through death chamber windows.
“I love you all. … I feel it,” he said. He was pronounced dead
23 minutes later.
Prosecutors said Sparks first stabbed his wife, then-30-year-old
Chare Agnew, 18 times as she lay in her bed. He then went into
the bedroom of his stepsons, Harold Sublet Jr. and Raekwon
Agnew, took them separately into the kitchen, and stabbed them.
Raekwon had been stabbed at least 45 times.
He then proceeded to rape his stepdaughters.
The U.S. Supreme Court also denied a request by Sparks’
attorneys to stop the execution; they alleged the jury had been
improperly influenced because an officer had worn a necktie with
a syringe on it, indicating he supports the death penalty.
The attorney general’s office said the jury foreperson said she
never saw the tie and did not believe it influenced jurors.
