The Tennessee Supreme Court set an execution date of Aug. 9,
2018, for Billy Ray Irick, who was convicted of the 1985 murder
and r*p* of Paula Kay Dyer, age 7, in Knox County, Tn. The Court
received notice from the State Attorney General on January 11,
2018, that the United States Supreme Court had denied the
defendant’s appeal challenging the constitutionality of
Tennessee’s lethal injection protocol. Under Tennessee Supreme
Court Rule 12.4(E), the Court, on its own, may set a new
execution date when a case with a previous execution date had
stays or reprieves lifted or dissolved. Irick has had multiple
previous execution dates.

Convicted child killer Billy Ray Irick will face the death
penalty on Thursday after a court refused to stay his execution.
The 59-year-old, who was convicted of raping and murdering
seven-year-old Paula Dyer in 1985, has been moved to death watch
this week - meaning he is in an 8ft by 10ft cell in sight of the
death chamber with strictly regulated visitation rights.
The move brings Irick close to becoming the first inmate
executed by Tennessee since 2009 and without intervention he is
set to be put to death on Thursday.
Paula's mother, Kathy Jeffers, told WBIR-TV: 'What he did to her
is the reason he's where he is.
'I am sick of hearing about his pain and his suffering. What
about her pain and her suffering?
'She was seven years old, raped, sodomised, and strangled to
death. I'm sorry, I feel nothing for his pain. Nothing at all.
God, forgive me, but I don't.'

Supreme Court denies stay of execution for Billy Ray Irick,
Haslam will not intervene--
August 6, 2018
The Tennessee Supreme Court ruled that the scheduled execution
of Billy Ray Irick should proceed as planned on Thursday,
denying his request for a stay.
Shortly after the Monday evening ruling, Gov. Bill Haslam
announced he would not intervene and would allow the execution
to go forward.
“I took an oath to uphold the law," Haslam said in a statement.
"Capital punishment is the law in Tennessee and was ordered in
this case by a jury of Tennesseans and upheld by more than a
dozen state and federal courts."
The Supreme Court said it 'must deny Mr. Irick’s motion'
In an order issued by a majority of the five-person court, the
court said that, according to existing rules, it "must deny Mr.
Irick’s motion."
Irick, 59, was convicted in 1986 of the r*p* and murder of a
7-year-old girl in Knox County. Although Irick has exhausted
appeals on his original case, he asked the court last week to
delay his execution so he and 32 other death row offenders could
continue their legal challenge of the drugs Tennessee intends to
use to kill him.
The death row offenders argued the three drugs Tennessee plans
to use will torture inmates to death. They also said the state
did not do enough to find a drug that would provide a more
humane death.
Davidson County Chancellor Ellen Hobbs Lyle disagreed. After a
two-week trial in July, Lyle ruled against the inmates, saying
the state did enough to attempt to find other drugs. She did,
however, agree experts provided by the inmates gave compelling
testimony about the potential for the lethal injection drugs to
not work as intended.
She determined while an offender may feel pain, that pain would
not rise to the level of torture.
But in his statement, Haslam defended his decision not to act,
noting state and federal courts "have reviewed and upheld the
jury’s verdict and sentence on 17 different occasions."
Haslam's statement was resolute, suggesting he was satisfied
with the judicial consideration of all the facts.
"My role is not to be the 13th juror or the judge or to impose
my personal views, but to carefully review the judicial process
to make sure it was full and fair," Haslam said. "Because of the
extremely thorough judicial review of all of the evidence and
arguments at every stage in this case, clemency is not
appropriate.”

Death row inmate Billy Ray Irick moved to death watch ahead of
Thursday execution date--

The Tennessee Department of Correction confirmed Tuesday that
death row inmate Billy Ray Irick had been moved to death watch,
a period of increased supervision and security ahead of his
execution date later this week.
Irick, 59, was moved to death watch at 11:30 p.m. Monday; he is
scheduled to die by lethal injection Thursday. The Tennessee
Supreme Court and Gov. Bill Haslam have both denied requests to
delay the execution.
"Death watch is the three-day period before an execution when
strict guidelines are implemented to maintain the security and
control of the offender and to maintain safe and orderly
operations of the prison," the department said in a statement.
Irick has been moved from his normal Riverbend Maximum Security
Institution cell to one next to the execution chamber.

Paula Dyer walked half a mile to school in the rain the day she
died.
She ate her last meal as a cold supper of canned corn and peas.
She died in her mother's bed, fighting for air against the man
she called "Uncle Bill."
"That was her last day on Earth," said Don Wiser, who worked the
case as the Knoxville Police Department's lead investigator. "I
saw her body at the hospital that night — just a beautiful
little girl. You had to wonder who could do something like that
to a 7-year-old child."
A day later, Wiser looked the man who killed her in the eye —
and 33 years later, he's counting down to that man's last day on
Earth.
Billy Ray Irick never told police why.
Irick told his friend Kenny Jeffers, "It's Paula," he said. "I
can't wake her up."
Jeffers came home to find Irick waiting on the porch and Paula's
body lying half-naked on her mother's bed, a puddle of blood
between her legs.
She never woke up. Doctors pronounced her dead that morning.
An autopsy found Paula died of asphyxiation — maybe strangled,
maybe suffocated by a pillow — after being raped twice, orally
and vaginally.
Wiser, now retired, still remembers the burst blood vessels in
Paula's face and eyes.
The family buried her with a Cabbage Patch Kids doll beside her
in the child-sized casket.
The search for Irick ended the next day when a passerby's phone
call led Wiser and other KPD officers to find him at the Baxter
Avenue ramp to Interstate 275, trying to thumb a ride out of
town. A few hours later, he admitted killing Paula, signed a
confession — even made a few edits, Wiser recalls.
He still never said why.

burger combo as last meal before execution--

A Tennessee convicted child rapist and killer on Wednesday
picked a deluxe burger combo as his last meal before his
execution -- the first in the state in nearly a decade.
Billy Ray Irick, 59, chose the deluxe combo that included a
super deluxe burger, onion rings and a Pepsi soft drink, the
Tennessee Department of Correction said Wednesday. Irick, who is
being held at Riverbend Maximum Security Institution in
Nashville, will eat his last meal before his execution, which is
scheduled for 7 p.m. Thursday.
Death row inmates are given a $20 limit to spend on their last
meal, the Tennessean reported.
On Monday, the state Supreme Court denied a stay of Irick's
execution, saying a lawsuit filed by inmates contesting the
execution drugs being used wasn't likely to succeed.

Supreme Court clears way for Tennessee to execute murderer--

The U.S. Supreme Court on Thursday denied a last-ditch petition
seeking to halt the execution by Tennessee of a man convicted of
the 1985 r*p* and murder of a 7-year-old girl he was
babysitting.
The decision cleared the path for the lethal injection and came
just hours before the state was scheduled to put to death Billy
Irick, 59, at 7 p.m. CDT (0000 GMT) at the Riverbend Maximum
Security Institution in Nashville. The execution would be the
first in the state since 2009 and the 15th this year in the
United States.
He was convicted of raping and strangling Paula Dyer in
Knoxville. Irick had been a boarder in the home where the girl
lived with her mother, stepfather and siblings.
Tennessee state prosecutors have said Irick knew what he was
doing was wrong and is competent to be executed.

Tennessee executed Billy Ray Irick on Thursday night, after the
U.S. Supreme Court denied a final request to stay his execution.
Convicted of the 1985 rape and murder of 7-year-old Paula Dyer,
Irick, 59, is the first state inmate to be put to death since
2009.
On Thursday, Irick’s execution began at 7:26 p.m. at Riverbend
Maximum Security Institution in Nashville. He was pronounced
dead at 7:48.
