Yes, he was. I read the article. But clearly the hospital
wasn't his "boss" and didn't seem to have oversight over what he
did and how he did it. It might have been because the hospital
profited from the way this guy operated, I'm not sure.
But I am certain that if a doctor in the health group that my
primary care doctor is part of did this kind of thing, it would
not have been able to occur to this extent or for this length of
time. I remember, years ago, when one of the very best doctors
in that family practice group left to take an oversight position
for the network that my physicians group was part of. When
there are multiple doctors within a practice, there are
standards and records available to the other physicians. When
my primary is not available, the records she has made ARE
available.
This is my point - that a doctor should not be a "lone ranger"
even if practicing in or being employed by a hospital, because
the hospital is not overseeing the physician or the physician's
records in the way that a physician's group practice or network
would be doing.
It certainly seemed like this physician did not share his
records with other physicians or have other physicians covering
for him when he was away. I think that is a red flag in itself.

The hospital should have been his boss, but every time there was
a question - and there were times - the hospital cowed. He
threatened to sue and they said 'ok, never mind.' And yes, they
benefitted financially.

I'm going to disagree with this. There are many people,
particularly in professional services, who are sole
practitioners or who otherwise ARE the boss and who do not have
a boss.
A doctor or lawyer (or politician) often doesn't have a boss,
unless they are part of a practice. The professional licensing
organization can be the only one who has any oversight - and
that's generally only when serious professional violations have
occurred AND have been brought to the organization's attention.
And then the oversight is pretty darn weak.
This is honestly why I said doctors should not be "lone rangers"
- at least in my opinion. I think it's better if they are part
of a practice.

Hospitals have a Chief Medical Officer not exactly a boss but
someone who is supposed to keep an eye on outliers.
The in house review group obviously didn't do their job.
There were layers upon layers of failure in this story.
