Bakari stepped from the bus, wearing his orange jumpsuit and
shackles. His hair looked a mess and he looked as if he hadn't
slept in days. He got ushered into a holding room. Today was his
preliminary trial date, and after everything that had happened,
he was more confused than he'd ever been. Between Kemena
announcing her pregnancy and his sister appearing in town on his
behalf, he didn't know up from down anymore. His inmate number
got called and he stood up, walking to the front. He saw his
sister standing next to a woman in the hallway. They both perked
up when they seen him as he came through the door.
Bakari. Who this?
Janelle. This is Charlotte, the lead attorney on your case.
Bakari. I don't know her. Damn sure can't afford her.
Janelle. She's good, and she's already paid for.
Charlotte. Listen, I know you don't know me. But, I'm your best
shot of getting out of here.
Bakari hesitated, but sighed and nodded.
Charlotte. Today is just a bail hearing, okay? Step one.
Janelle. If we can get you out on bail, it makes defense a lot
easier.
Charlotte. Because if the judge doesn't see enough evidence to
not give you bail, then it's more likely a jury won't see enough
evidence to convict you.
Bakari. Just get me home to my kids and my girl, man. Aite?
Charlotte nodded. They went their separate ways and soon enough,
they were standing before the judge with the district attorney.
Judge. This is a preliminary bail hearing on Bakari Ali, charged
with first degree murder. How does the defendant plead?
Charlotte. Not guilty, Your Honor.
Judge. I'll hear the People on bail.
DA. Remand, Your Honor. The defendant is a flight risk with
known ties to criminal organizations.
Charlotte. You want to keep my client in jail because he has
friends?
DA. Your Honor, there's video evidence of the defendant leaving
the scene of the crime.
Judge. This isn't trial, that doesn't matter here.
DA. The defendant has ties to Carver City, Texas, your honor.
Family, including a son.
Charlotte. He also has family here who is willing to vouch that
he will not skip bail, and will appear at every court date. He
also has a pregnant girlfriend, who only has ties here in
Hamilton Beach.
DA. Where is the Defendant's family?
Janelle rose from her seat.
Judge. Janelle Carmichael?
Janelle. It's Ali now, Your Honor.
Judge. You're the family of the defendant?
Janelle. Yes, his older sister. And I can assure you that I will
remain in Hamilton Beach until after his trial.
Judge. And you can assure this court that he will be in
attendance?
Janelle. Yes.
Charlotte. Which is why we believe remand is too harsh.
There was a pause.
Judge. I'm inclined to agree.
DA. Your Honor--
Judge. The defendant does not have any violent prior
convictions, clear ties to the community, and has plead not
guilty. He quite clearly plans to fight the charges brought
against him, leading me to believe that he is not a flight risk
and should be granted bail. Bail is set at $500,000 cash or
bond, and the defendant will be released into the custody of his
sister, Janelle Ali.
The judge banged his gavel and Bakari stood there, shocked. He
turned and hugged Charlotte with all of the strength he had. He
then hugged Janelle and kissed her cheek.
Bakari. Thank y'all, man. Who the hell is Janelle Carmichael?
Janelle. I'll explain later. I'm going to post your bail right
now.
Janelle rushed off as Bakari sighed. He was happy he was getting
out, but he knew it meant that he would have to have a
conversation he wasn't ready for...he would have to face Kemena.
