       I hope you will be able to help me.
       HMCTS letter received.
       Issued date 18/02/2026.
       AoS submitted today - 21/02/2026
       No appeal.
       1.The Defendant is indebted to the Claimantnfor Parking Charge
       issued to vehicle...
       2.The date of contravention is 14/09/2025
       3.The Defendant is pursued as the driver of the vehicle for
       breach of terms on the signs( the contract).Reason: Parked
       without Displaying A Valid Permit.
       4.In the alternative the Defendants pursued to POFA
       2012,schedule 4.And the claimants claim:
       1.£170 being the total of the PC and damages.
       2.Interest at a rate of 8.00% per annum pursuant to s.69 of the
       County Courts Act 1984nfrom the date hereof at a daily rate of
       £0.03 until judgment or sooner payment.
       3.Costs and court fees.
       Amount claimed £175.12
       Court fee £35
       Legal representation.costs £50
       Total amount £260.12

       Background:
       This matter concerns a residential parking area at development
       where driver reside.The parking space in question is allocated
       to driver flat and driver is  an authorised resident. At the
       time of the alleged contravention, driver  was in possession of
       a valid parking permit issued by the managing agent.However , on
       that particular day ,Driver  inadvertently failed to place the
       permit in a visible position inside the vehicle .The vehicle was
       parked in driver allocated residential space and driver was
       fully entitled to park there.

       The driver’s lease is unlikely to require the display of a
       permit, but you should research this and post it here along with
       the notice you’ve received for further advice.

       Parking permit MUST be visible per parking rules.
       Unfortunately I don't have the PCN.
       I try to attach photo for the topic but I can not see the option
       here any suggestion how to do that please.Thank you.

       they’re probably not enforceable.

       Was the allocated parking space specifically advertised /
       mentioned when you first moved in?
       Was the parking scheme already in place when you moved in? Or
       was it added after?
       Does your parking pass have your specific vehicle registration
       mark on it?
       It is our experience that parking operators 'make it easy' for
       tenants to get caught out by these parking schemes - your
       situation demonstrates that point precisely.
       Of course, the operator could easily keep a record of authorised
       vehicles which would prevent this kind of thing happening - but
       then they'd issue very few PCNs.
       You see how this works?
       Ultimately, if you're provided with an 'allocated space' then
       you can probably demonstrate 'primacy of contract' meaning; that
       by renting the flat (including the parking space) you already
       have sufficient legal permission to use that space and as such
       there is no additional requirement on your part to form a
       further contract with a third party parking operator.
