They have no deadline, but cannot begin to collect the debt
until they do it, so hopefully not too long.

Woohoo, Morning all, finally today noticed it's gone up by £10
to £250. Took their sweet time. So will either wait for their
letter, or can print off the form, tick and send off!!

Best to download the form, complete it and send it off. Mail is
too uncertain these days. PCN is under Traffic Management Act,
so you need the Witness Statement form.

Hi Incandescent, sorry to be a pain... I downloaded form
already, but on the Witness statement section, do I just outline
what they've written or do I write the reason on a different
plain A4 sheet and add with the form? i/e:
•You paid the penalty charge notice in full. You must provide
details of the date payment was made,
the method of payment i.e. cash, cheque etc and who the payment
was made to. Please note you
may be asked to provide proof of payment upon request.
• You did not receive the notice to owner/penalty charge notice.
• You made representations about the penalty charge notice to
the Local Authority within 28 days of
service of the notice to owner but did not receive a reply
(rejection notice).
• You appealed against the Local Authority’s decision to reject
your representation within 28 days, but
you had no response to your appeal.
..And I assume it's the third paragraph i'm
highligting...correct?

Hi Incandescent, I filled in the form, (TE9), on the 28th of
March and posted as "Signed for" via Royal mail tracked along
with a letter outlining the fact I never received the email on
the failure of representation. So that was over 8 days ago but
on the TFL PCN website there's been no change. Would there be
any change in the history section saying they've received the
TE9 form?
The form has definitely been signed and received by the address
it was sent to. I'm wondering now if I should've made an email
representation as well alongside physical paper.
Any idea?

The form should have been sent to the Traffic Enforcement
Centre. At one time they turned round these very quickly, but
those days have gone, so it could be some days to go.
I presume you sent the form to TEC, but am puzzled why you
mention TfL. If you sent the form to TfL you have cocked things
up royally.

Thanks for the reply Incandescent, sorry the PCN was from TFL
and no I didn't sens to them. I sent it to the Traffic
Enforcement Centre and as per address that was listed on the
back of the TE9 form.
Sorry for the confusion mate. Will wait to see when and if they
reply then.

IMO, pl stop fretting - it may be difficult, but you've been
told the procedure by posters, so pl wait for it to grind on.
If you made a properly completed submission in time to TEC-by
ticking the box as advised, signing and sending to the address
as directed on the form - then what follows is automatic and
mandated under the regs, TEC has no discretion in the matter:
the Order for Recovery will be cancelled, the Charge Certificate
similarly and then the ball is in TfL's court. If they wish to
pursue the penalty, they must refer the matter to the
adjudicator for directions. No ifs or buts, it's automatic.

Sorry Tincombe, I only fret because they seem to slip procedures
as they did when they apparently had sent me the email.. which
was never received.
I shall be patient.
