I was surprised to receive this PCN for driving in a Bus Lane.
On looking at the evidence, I pulled out, into the end of the
bus lane, about 3 seconds early, mostly as there was standstill
traffic in my lane.
There is no clear marking of where the bus lane ends.
Do I have a case here?

Dear Sir or Madam,
I am writing to make formal representations against the above
PCN for the alleged bus lane contravention (Code 34J).
After reviewing the council’s video evidence, it is clear that
my vehicle entered the bus lane only momentarily — immediately
before the end of the restriction. This was not an attempt to
gain advantage or bypass traffic, but part of positioning
safely. The incursion was minimal, brief, and occurred right at
the termination point of the bus lane.
Importantly, the end of the bus lane was not clearly marked or
sufficiently conspicuous at this location. There was inadequate
visual distinction indicating where the restriction ceased,
particularly for a driver focusing on surrounding traffic and
preparing to turn. Without clear and prominent termination
markings and signage, a driver cannot reasonably be expected to
judge the exact point the restriction ends in real time. This
makes enforcement at that precise location unfair.
Given:
The extremely short duration of travel in the lane
The fact this occurred immediately at the end of the
restriction
No advantage was gained and no bus was impeded
The lack of clear termination markings
this falls squarely within the principle of a trivial or de
minimis incursion. Enforcement in these circumstances is
disproportionate.
I respectfully request that the council exercise its discretion
and cancel this PCN.

cancelled.

The video does not show the vehicle allegedly passing any
upright signs pertaining to the bus lane. The alleged infraction
is de minimis.
Please cancel therefore.
