Elite parking pcn

Hi all ,
Got a pcn for parking in contractor/visitor parking without
displaying a permit.

looked up at the picture they took and it doesn't show the sign
(behind the van)

Any ideas on how to challenge it? can I challenge the fast that
the pictyure only shows my van parked up without the sign and
therefore there is no contravention

Before we get into appeals, I note this is a British Gas van -
who is the registered keeper of the vehicle, British Gas? I ask,
as this may affect the approach to appeals.

If you do, they'll probably refer you to one of the other
pictures taken at the time, showing the vehicle parked directly
next to the sign:

A far stronger challenge would seem to be that the ticket was
issued for "parked in a Contractor / Visitor Bay without a valid
permit", but the terms on the signage do not require a permit to
be displayed. Do you have (or can you acquire) evidence to
demonstrate that the driver was working as a contractor at that
site?

If you mean after 28 days elapsed, they will pay and pass it to
driver via payroll

This weakens your position somewhat, insofar as on the face of
it, the driver was not a genuine visitor or contractor. One
angle that still remains is to argue that the signage does not
extend a contractual offer to park to those who are not visitors
or contractors. The downside of this argument is that there's a
fair chance that neither the parking company nor POPLA would
accept it, so you'd need to be prepared to defend a potential
court claim, which we can of course advise with.
Our ordinary advice with windscreen notices is to appeal as the
keeper (not revealing who was driving) as this can lead to
technical arguments you can exploit, but this seems like it
would not be viable in your case as the keeper is British Gas
who will just pay up.
