Hi guys, unfortunately I think I may be liable to pay this one.
However, I thought it would run it by your expertise. Thank you
in advance. No PCN’s in 2025 and then hit with three around
Christmas.
I (perhaps foolishly) already appealed this PCN on the basis of
compassionate grounds. We had a bereavement in the family which
hit us all hard. I parked very briefly outside a family member
house 10-15 minutes max. I was actually very well aware of the
parking restrictions, but was a challenging moment and lost my
head. Ironically there were unrestricted spaces on the other
side of the road. Unsurprisingly Haringey was uninterested in my
appeal. I was wondering if this particular PCN would be a losing
battle.
I’m couldn’t find the initial correspondence, i will look again.
However, here is my latest paperwork, including a rejection
letter.
Thanks again for your time and the amazing advice available in
this forum.

So what do you think might be a legally robust argument ?
Presumably you did park on a single-yellow line during its
restricted hours. You were there for 10-15 minutes. There are
two exemptions to yellow lines, (1) loading/unloading, and (2)
boarding/alighting passengers. Do either of these apply ?
In addition to the above, there may be a 'technical' appeal
based on Haringey mismanagement of the enforcement process. Such
appeals have nothing to do with the alleged contravention and
are invariably dealt with at London Tribunals, with the full PCN
penalty in play. Quite a few have now been won, but clearly, you
are taking a double-or-quits gamble. If you win, you pay
nothing, if you lost you pay the penalty, but there are no
additional costs.

Hi there thanks very much for your reply. Do you think there is
a case at all for a technical appeal from the documents sent?
Unfortunately I don’t think I have a leg to stand on legally.

Sorry, but can you please explain why you have posted documents
relating to two PCNs, one for entering a restricted street at
09.51, and others for the parking contravention, the subject of
this thread.

Hi there where have I done that ? Are you referring to the other
images that I have uploaded on my imgpile, or the seperate
thread I began relating to another PCN.

Hi there, this is strange wording, but it still relates to
parking on a yellow line on hatherley gardens. Perhaps that’s an
opportunity to appeal

images related to two separate PCN’s on the same IMGpile. I
tried to upload links, that when I click them take you to the
specific documents referenced.
Would it be better if I reuploaded them for clarity?

I don't think so, as everybody knows the problem.The relevant
documents are there.

Haringey should not fetter their discretion by writing that they
must treat you like everyone else and then they are 'unable' to
cancel when they are, for now, the only people who can cancel.
The whole point about discretion is that it leads to different
outcomes based upon how compelling the personal circumstances
are seen to be.
Management at Haringey now listen to me & me to them. If I raise
a complaint about the wording they might cancel. My main concern
in this though is to stop them writing that again in the future.
One adjudicator allowed a case on this basis, claiming to be
unable when they weren't and another refused as he said it was
mere semantics, they meant unwilling, so it all depends on the
adjudicator).
