NCP PARKING CHARGE TO KEEPER CARDIFF

Hi all,
I have a cheeky parking charge to keeper from NCP in Cardiff
Adam street. The driver drove into this car park, entrance being
immediate left turn off main road Adam street however the slow
traffic and narrow roads within the car park causing a major
delay the driver decided to drive straight back out and park
elsewhere, driver was thinking driver don’t want to be in
this chaos few hours later when the driver comes back to the
vehicle. Driver did not park there and indeed it was chaos
getting back out.
Looking at the entry and exit times, it took the driver 12 mins
07 seconds to get back out. I don’t remember the exact
date I received this letter in the post, it was around Christmas
as I was very poorly and admitted in hospital for one week. I
only opened the letter few days ago.
I was very tempted to call NCP and ask them to view their cctv
video footage and clarify exactly where the driver parked? It
would be evident that the driver did not park and only drove in
and straight back out. I thought it would be wise to get some
knowledgeable advice here before I make any contact.
I notice the date of incident 16/11/2025 and date of NCP sending
this was 15/12/25 also given the busy time of year postal
service is usually delayed.
I greatly appreciate your time and any advice offered.

Do not call NCP, ever.
Do not identify the driver. Do not say “I”, all the time.

I thought I read somewhere on this forum not sure maybe
elsewhere, for private parking Ntk they must write within 28
days of incident?
I can’t find where I read this I’ve been searching on this
forum.

If they want to rely on the provisions of Schedule 4 of the
Protection of Freedoms Act (2012) to hold you liable as the
registered keeper of the vehicle, they must deliver the notice
within 14 days. They have failed to do so. You can therefore
appeal along the lines of the below, as the keeper only:
[indent]Dear Sirs,
I have received your Parking Charge Notice (Ref: ________) for
vehicle registration mark ____ ___, in which you allege that the
driver has incurred a parking charge. I note from your
correspondence that you are not able to hold me liable as the
registered keeper, under Schedule 4 of the Protection of
Freedoms Act 2012 ("The Act"). You have failed to issue a Notice
to Keeper in accordance with The Act, and it is now too late for
you to do so.
There is no obligation for me to name the driver and I will not
be doing so. I am therefore unable to help you further with this
matter, and look forward to your confirmation that the charge
has been cancelled. If you choose to decline this appeal, you
must issue a POPLA code.
Yours,[/indent]
Separately, their notice wrongly implies that they can pursue
you as the keeper - this is a breach of the Private Parking
Sector Single Code of Practice. You may wish to complain to NCP
(and subsequently the British Parking Association) about this
misleading conduct.
