       N1DST received DCBL on behalf of Smart Parking Ltd

       Hi B789 & Richard W
       I hope you are both well and Happy New Year!
       I have come across your very useful advice on this forum post.
       I was hoping you could give me some advice as I have received an
       N1DST from the Courts for DCBL Legal on behalf of Smart Parking
       Ltd (Issue date 22/12/2025) and know that I now need to act to
       avoid any potentially risk of a default CCJ.
       For background:
       This PC claim first came to my knowledge when I received a
       letter from DCBL on 24/10/2025 in relation to an alleged
       infringement on 18/05/2024 at a Smart Parking car park. FYI - I
       moved house in June 2024 and updated by licence but forgot to
       update the V5C unfortunately.
       As this was the first I had heard about this PC, I challenged it
       using the online tool on the Smart Parking website letting them
       know I would like some evidence of the infringement and told
       them this is the first I have heard about it - They replied with
       two images (one entering and one leaving the car park) and said
       that I didn't pay for long enough for the duration stayed. They
       said it was too late to challenge and that it had been passed to
       DCBL and I had to deal with them directly. - I ignored the DCBL
       letter.
       I then received a second letter from DCBL Legal this time on
       13/11/25 again demanding £150 and the usually threatening
       language - I ignored also.
       On 29/12/2025 I received a N1DST claim form from the courts with
       the issue date of 22/12/2025. Now requesting a claim of £251.56
       (Claim: £166.66, court fee: £35 & legal costs:£50).
       I honestly can't remember the day and the duration spent at the
       parking location but I have no intention of paying these crooks
       £250 but I know I have 14 days now to do something - so I was
       hoping you could provide me with some advice on how to proceed.

       So did you submit an AoS as advised above?

       A letter before claim should not be ignored, it is a chance to
       show that you are not an easy touch.
       Did you identify the driver in any correspondence to smart?

       Hi Dave,
       In my chain of events isn’t fully accurate I did call up DCBL
       and say I would challenge directly with Smart parking as I never
       received the original PCN.
       What do you mean by identify the driver to Smart? I can tell
       it’s me from the pictures they sent but I didn’t confirm it was
       me driving.

       Nobody can identify the driver from pictures, think about it.
       The only way they know who the driver is is if you tell them
       explicitly.

       This forum will help you.
       First do a search on this site(top box) for Smart posts and DCBL
       legal, b789 has very good advice with these.
       b789`s usual advice is that they will most likely discontinue
       the claim.

       If the OP were to defend on the basis of putting the PPC to
       proof that he was the driver, and they have photos that clearly
       show the OP driving, a District Judge might well be able to
       identify him from those photos or otherwise ask him if he was
       the driver.

       Thanks Dave/Andy, I also noted b789’s advice on here.
       Would it be appropriate to use the same defence b789 provided on
       this thread?
