It must be served within 6 months of the contravention date. It
can only be served after the 28 days to respond to the PCN has
expired. Service beyond 3 months is usually regarded as unfair
by London Tribunals adjudicators, but what the general view is
within the Traffic Penalty Tribunal that covers Birmingham I
don't know.

"the contravention did not occur - de minimis" The legal maxim
of "de minimis non curat lex" must surely apply here, and
anyway, the NtO means the discount option has now gone, so make
them do some work for their money !

Thanks i will use that ground and see what happens
yep need to pay full £70 . i wanted to see if they will abide by
there own guidelines if they reject i will go to tribunal . not
gunna cost me anymore

I wouldn't concede even a trivial contravention - when parking
you are allowed to consult the parking sign.
