PCN code 01 parking in restricted area.

Posting on behalf of someone who does not have access to
internet.
Circumstances are parked on a road in Swansea on double yellow
lines. Displayed Blue Badge and was issued with the above PCN
code 01. The car was parked partially on the pavement. They
appealed the PCN on the basis the PCN states parked in
restricted area I.e. parked on double yellow lines.The Council
have come back stating that it was issued for causing an
obstruction.
The website state that highway obstructions should be reported
to South Wales Police.
Looking for advice on whether they can issue a PCN for one
alleged offence and move the goal posts to another.

Just an update for further information the council received an
appeal as person was displaying blue badge they stated in their
rejection that the PCN was issued correctly as any obstruction
nullifies parking with a blue badge displayed. Had they parked
on the road then no PCN but by parking partially on the pavement
this PCN was lawful. Any advice welcome.

Please read this and update your thread accordingly so that full
advice can be given:-
The bottom line is that councils cannot serve PCNs for
'obstruction' unless it's in an off-road car park. This offence
is a police matter. However, is your friend willing to take them
all the way to the Traffic Penalty Tribunal ? If he isn't, it's
a bit pointless taking the matter further.
