Council Penalty Charge Notice

Is there anything I can do to challenge the below PCN. I did pay
for parking via the app - in fact, I overpaid for a whole day.
But when the PCN was issued I had not paid for parking at that
point in time. I did appeal but - This is their response.....

Thank you for your correspondence in respect of the above
Penalty Charge Notice (PCN).
I write to advise that your representation made in response to
the Notice to Owner was received after the case had escalated to
Charge Certificate. I confirm that the Council is not required
to take any correspondence into account once it has reached this
stage. However, I have reviewed this case.
A condition of use of this car park requires motorists to
purchase a parking session at the time the vehicle is parked,
which remains valid for the duration of their stay. A
contravention occurs if a motorist leaves the car park without
making payment.
Our records show that you did purchase a cashless session for
your vehicle but that the payment was made at 11:11, which was
after the PCN had already been issued.
Furthermore, while we do allow motorists a small window of time
in which they can purchase a session after the vehicle was
observed, your session was purchased outside of that window.
Therefore, I can see no reason to cancel the PCN on this
occasion.
You were given the opportunity to challenge the penalty charge,
but representation was not received by the date stated on the
Notice to Owner. Now that case has gone to Charge Certificate,
you have forfeited your right to appeal, and the Charge
Certificate has now been issued increasing the penalty charge by
50% to £75.00. Failure to pay the increased amount may result in
registration of the debt at the County Court and, ultimately, a
warrant being issued to enforcement agents.

Please tell us more about the representations you submitted,
because they mention a Notice to Owner that you were too late to
respond to. Were those reps submitted against the PCN or the NtO
? Better if you post up the PCN and the NtO and your reps.

So you got a windscreen PCN, did not challenge?
And then an NTO, and missed the representation deadline?
And you then got a charge certificate?
We can only check things if you post all the documents, hiding
only name and address.
All I can tell is it's not in London.

I did not get a PCN on my windscreen. The first I knew was
getting an NTO to my home.
I appealed on 11th August, that was rejected.
I appealed again on 25th November, that was also rejected.
I now have a letter saying there is a Charge Certificate.
I can provide a copy of the latest letter and the two appeal
responses.
I will see if I can find my appeals too, but they were filled
out online.

As Stamfordman says, please post the documents.
Your reps of 11th August against the NtO were rejected. So you
had only two options after that, (1) pay the PCN, and (2)
register an appeal at the adjudicators, but you did neither, you
submitted a late second representation and got a Charge
Certificate. Councils are not legally liable to accept and
consider late representations. Their letter points this out and
also does not cancel the CC.
So in submitting a late second representation, you have lost the
option to register an appeal at the adjudicators. Having said
that, they may accept a late registration.

I saw photos of this online too but the PCN was not on my
windscreen when I arrived back at my vehicle.
So who is the adjudicator that I can contact potentially?

The NTO will contain details of the adjudication process.
The information you have posted confirms that a parking session
was paid for but that this was over 50 minutes after you parked,
can you clarify the reason for this delay?

We went to Soft Play City next door and there were delays with
their card payment system and then my son hurt himself straight
away so I was distracted. Paid as soon as I realised for
comfortably enough time. I believe we parked for 5 hours but I
paid for 8. I dont know if I still have the NTO but will check.
