       Countrywide Parking Management - PCN issued at Doctors Surgery

       Good afternoon.
       I received a parking charge notice from Countrywide Parking
       Management back in May this year.
       I was sent to an out of area surgery for a consultation.  I
       arrived to a totally empty car park and straight away saw the
       signs advising free parking if you registered you vehicle.  I
       went straight to the desk and asked the staff member where the
       machine was to do this.  She answered that she would register
       it, asked me for my car registration, which I supplied, and she
       confirmed it was all done and I went to my appointment.
       A few weeks later got a PCN from CPM, with photos showing my car
       arriving at 14:49 and departing at 14:57 (12 minutes).  I
       immediately appealed and explained the staff member registered
       it.  They turned down my appeal.  In the meantime I tried to
       contact the clinic direct but kept getting emails saying 'its
       not us' and I have not been able to ascertain an email address
       for the clinic.  It is a hub for London Borough of Havering and
       is not listed anywhere so I could not get anyone to confirm what
       happened.
       I didn't hear anything further and assumed that the clinic had
       confirmed what happened but today I recieved a final demand.  I
       am not paying this under any circumstances as I registerd my
       vehicle the way the staff member advised.  If she had pointed to
       a machine I would of course used it but her asking for my
       registration led me to believe that was how you did it.
       Do I just ignore this?  Write back?
       I have just noticed that the 'contravention' is marked as
       happeneing at Tulasi Medical Practice RM9 5QP.  I did not visit
       that place.  I was at 'Parsloes Hub' with the same postcode, so
       they have not put the place where I parked on the invoice, hence
       when I contacted Tulasi they had never heard of me.  Perhaps
       this helps - the fact they have charged me for parking in a
       place that I was not parked at?

       Can you show us both sides of the original Notice to Keeper
       (NtK) you received. AS for any debt recover letters, you can
       safely ignore those. Debt collectors are powerless to do
       anything except intimidate the low-hanging fruit on the gullible
       tree into paying out of ignorance and fear.
       What EXACTLY did you put in your appeal?

       I don't have a copy as it was using their online portal, but I
       just basically told the truth of what happened.  I did not at
       that point realise the place they said I parked was different to
       where I actually parked.  I have scanned the letters and the
       upload link is here - hopefully I have done it correctly.

       Unfortunately, you have cropped off the most important date we
       need to see on the copy of the ONLY document we need to see, the
       original NtK. The reminders are as useful as a poke in the arm
       with a sharp stick.
       For now, just tell us the date the original NtK was issued. Not
       the date of the alleged contravention.
       I am going to assume that in your appeal, whilst trying to be
       truthful, you, the Keeper, identified as the Driver. For future
       reference, you must never, ever, EVER, identify the driver. They
       have no idea who that is until you blab it to them,
       inadvertently or otherwise.
       All you had to do when appealing as the Keeper is to refer to
       the driver in the third person. No “I did this or that“, only
       “the driver did this or that”.
       In this case, if you have identified as the driver, you have
       lost whole lot of extra protection, However, there is no
       evidence of actual parking. Their ANPR only shows entry and exit
       of the land, not time parked.
       Their ANPR only NtK states that the charge relates to “the
       period of parking”, which it does not. Many claims have been
       thrown out by clever judges who understand the nuance of these
       spurious claims.
       For now, please tell us the date the initial NtK was issued and
       confirm whether the Keeper has been identified as the driver.

       Apologies for the delay.
       The NTKis dated 5th June 2025.
       Date of event is the 28th May 2025.
       It refers to a parking charge that is unpaid, but there was no
       parking charge to pay.  It was free parking at a doctors
       surgery.  To park you had to register your vehicle, which I did
       to the staff member.
       Unfortunately you are correct - I did naively write 'i did etc'
       so confirmed I am the driver.  I will not be so gullible in
       fiture.
       I cannot find a record of my appeal but I did explain I drove
       in, saw the signs, went to the desk, gave my registration
       details, was seen straight away and then left.  All within 12
       minutes.
       Is there anything I should so at this stage?
       Really appreciate the advice.

       You can safely ignore all debt recovery demands. Debt collectors
       are powerless to do anything except to try and intimidate the
       low-hanging fruit on the gullible tree into paying up out of
       ignorance and fear.
       This will eventually escalate to a county court claim. That is a
       good thing. They really don't want to have to explain themselves
       in format of a judge and they are only doing this to intimidate
       you. The odds of it ever reaching a hearing are slim to none.
       However, you will have to respond and defend any claim. Are you
       prepared to do so? We will advise every step of the way.
       In the meantime here are a couple of complaints you can send.
       First is to Parsloes Hub (you can also adapt for London Borough
       of Barking & Dagenham / Havering if they have oversight of the
       hub’s contract):

       from my experience that patients are being put at risk of unfair
       tickets through no fault of their own.

       Send a formal complaint to CPM by email (via their
       appeals/”contact us” portal)

       of any parking terms, and CPM’s own trade body Code, as well as
       basic consumer protection law, has been breached.

       stating that parking was free but that motorists must register
       their vehicle. I immediately went to the reception desk to ask

       I fulfilled all obligations placed on me by the signage. It is
       not open to CPM to profit from its own or its principal’s
       failure.

       > 2. Mandatory consideration period – no contract could have

       > The Private Parking Single Code of Practice, jointly adopted
       by the BPA and IPC, requires operators to allow a reasonable
       consideration period for drivers to enter, read the terms,
       decide whether to park and comply, or leave, before any
       liability can arise.

       > Your own ANPR timestamps show an on-site period of eight
       minutes. In that time I:
       > [indent]– entered the car park,
       > – read the new parking signs,
       > – went straight to reception to ask how to register,
       > – provided my registration number to your principal’s staff
       member and was told it was done,
       > – attended a brief consultation, and

       >
       > Ticketing a patient in these circumstances is plainly
       incompatible with your obligations under the PPSCoP and any IPC
       Code of Practice that applied at the time. No reasonable
       consideration period was allowed and no enforceable contract to
       pay a charge ever arose.

       > 3. Incorrect site description – “Tulasi Medical Practice” is
       not where I parked
       > The Notice states that the contravention occurred at “Tulasi
       Medical Practice RM9 5QP”. I did not park at Tulasi Medical
       Practice. I parked at Parsloes Hub, which happens to share the
       same postcode.
       >
       > This mis-describes the location and fails to “specify the land
       on which the vehicle was parked” as required by Schedule 4 of
       the Protection of Freedoms Act 2012 if you wish to rely on
       keeper liability. It also raises serious doubts about the
       accuracy of your records and the mapping between your ANPR
       system and the correct site.
       >
       > Given that the alleged site is wrong, the charge is, on its
       face, invalid.
       >
       > 4. Consumer law and unfair commercial practice
       > By issuing a charge in spite of your agent’s assurance that my
       vehicle had been registered, CPM is engaging in a misleading
       commercial practice contrary to Part 4 (Unfair Commercial
       Practices) of the Digital Markets, Competition and Consumers Act
       2024. A consumer who has done exactly what they were told to do
       by staff should not be pursued for £100.
       >
       > 5. Required outcome
       > In light of the above, I require CPM to:
       > [indent]– Cancel PCN [PCN number] immediately; and
       > – Confirm in writing within 28 days that this matter is closed
       and that my personal data will not be further processed or
       passed to any third party for “debt recovery” purposes.[/indent]
       >
       > Should CPM refuse to cancel, then:
       > [indent]– I will treat this as a formal complaint and reserve
       the right to escalate to the landholder and relevant authorities
       including the ICO, and
       > – I require you either to issue a fully compliant Letter of
       Claim in accordance with the Pre-Action Protocol for Debt Claims
       or to confirm that no further action will be taken. I will not
       enter into any correspondence with debt collection agents, who
       are not a party to any alleged contract and have no
       standing.[/indent]
       >
       > Any continuation of this matter in the face of the facts above
       will be relied upon later in support of a request for costs on
       the grounds of unreasonable conduct, in the event that CPM
       elects to issue a claim and then fails.

       For now, you can safely ignore all debt demands. Come back when
       you receive a Letter of Claim (LoC).

       Absolutely fantastic.  I will do that straight away.  I could
       not find the email address of Parsloes Hub when I tried before.
       3 times I emailed people thinking it was Parsloes Hub but they
       were the Tulasi proactice and a few others that have very
       similar names.  I will try again however, and send the other
       email to CPM.  Yes I am very ready to defend this.

       I have found out there is no dedicated email address as it is a
       hub where people are sent from different surgeries so I have
       written them a letter and will post it instead.

       If you need to send anything by post, do not use recorded or
       tracked delivery. For any correspondence where you may later
       need to prove it was sent, simply post it first class and obtain
       a free proof of posting receipt from any Post Office.
       Under section 7 of the Interpretation Act 1978, a document
       properly addressed, prepaid and posted is deemed to be served in
       the ordinary course of post. If the intended recipient later
       claims it was never received, your proof of posting is usually
       sufficient evidence that it was duly served, unless they can
       produce strong evidence to the contrary.
