Hi,
I got a fine for driving in a bus lane in Cambridge. I must not
have seen the sign and just followed Google Maps. Is there any
way I could appeal this, as I am a student and don't really have
much extra money to pay the fine
I have attached the letter I received.
Would appreciate any advice on this can appeal

Oh dear, how often do we see this on this forum !
Never, ever, just rely on a satnav when driving in cities,
especially those that are pathologically anti-motorist like
Cambridge. you've just got to be alert for signs indicating a
restriction. A brief look on the latest GSV dated Oct 2024`
doesn't show any restriction so this is fairly new. So if you
want advice on challenging, you need to do some leg work with a
camera and post the results here. You'd be looking for an
advance sign on your approach, plus the actual restriction signs
at the start of Regent Street that you drove into.

Hi,
I've had a look at Google Maps and added the signs that I can
see.

Can you post a GSV link that gives those views, because I
couldn't find anything when I last looked.
Your photos show clear restriction signs that presumbly you
ignored and just drove past, plus an advance sign indicating the
restriction ahead, which again, you would seem to have missed.
Frankly you seem to have no grounds against the contravention
itself as far as I can see. However, we encourage OPs to submit
reps because sometimes the council shoot themselves in the foot
in their reply, giving solid grounds based on mismanagement of
the enforcement process.

I see now how I missed it; it's halfway down Regent St, not at
each end of it !
All you need to is tell them what you've told us in your opening
text. They'll no doubt refuse them. Are you a student in
Cambridge, or a visitor ? If a visitor, emphasise your
unfamiliarity with the streets and their various restrictions.

There is no bus lane signage in place. The only signs
placed are signs conveying a route restricted to certain
vehicles. In this case the signs convey that the route is
restricted for use by buses, pedal cycles and taxis only.
Contravening this sign is, according to
HTML https://assets.publishing.service.gov.uk/media/6294ddfa8fa8f5039a1bd695/annex-a-traffic-signs-subject-to-moving-traffic_enforcement.pdfGovt<br
/>guidance
HTML https://assets.publishing.service.gov.uk/media/6294ddfa8fa8f5039a1bd695/annex-a-traffic-signs-subject-to-moving-traffic_enforcement.pdf,<br
/>a moving traffic contravention and not a bus lane
contravention.
Therefore the appropriate contravention description is Code 33 -
Using a route restricted to certain vehicles. You can use the
text below in your formal reps but also wait to see if others
offer other angles of attack.
The Statutory Guidance for Local Authorities Outside
London on Civil Enforcement of Bus Lane and Moving Traffic
Contraventions issued by the Secretary by State for Transport
does under Annex A, advise that the round blue sign is a traffic
sign conveying a moving traffic contravention. The Council has
wrongly accused me of a bus lane contravention. The correct
description for contravening the sign is code 33 "using a route
restricted to certain vehicles"
As demonstrated by the aforementioned Annex A, the wrong
contravention description is stated on the PCN and for this it
should be cancelled. Should the Council not agree with this
point of law, I require the Council to give full reasoning for
any rejection with counter arguments directing me to the law
that the Council rely upon for their rejection and for
dismissing the guidance issued by the Secretary of State.
I suggest you also point out that the PCN is missing the
statutory ground of appeal below which also merits cancellation
of the penalty under the ground of procedural impropriety.
(i)the enforcement notice should not have been served because—
(i)the penalty charge has already been paid in full, or
(ii)the penalty charge has been paid, reduced by the amount of
any discount set in accordance with Schedule 9 to the TMA 2004,
by the applicable date as specified in paragraph 1(3) of
Schedule 3 to the 2022 General Regulations.

Do you guys think it's worth appealing or should I just pay the
fine?
