Hi,
I have now received a Letter of Claim (as opposed to the Letters
Before Claim I had before) from Moorside Legal.
It has the same wording of the Letter Before Claim, offereing
ways to pay etc but it does say
'if I do not reply within 30 days they may issue a County Court
Claim which adds interest, court fees and legal costs. If a CCJ
is awarded it can seriously affest your credit score for up to 6
years. This means you may find it more difficult to obtain
credit such as mortgages, credit cards, loans, or any vehicle
finance'
Should I be worried? I'd appreciate advice of what to do next.
I have sent all the emails that you advised before, and they
have not answered a single question. They just keep sending me
these letters.

Hi I got a Letter of Claim from Moorside Legal on 22nd January
but have not replied - I'm really worried now as I don't know if
I should be doing something. It said I have 30 days or I could
get a CCJ.
Is this just more scaremengering or should I do something? I
have previously sent the letters you suggested, which asked lots
of questions but have had no answers from them at all - just the
same claim for an unpaid invoice. Should I send them the same
letter again maybe, or just ignore?
I would really appreciate any help you can give me. Thank you.

Regardless of whether or not you reply to a Letter of Claim, you
will not get a County Court Judgement until you have been served
a claim from the court, a N1SDT form, and then either fail to do
anything or defend and lose. Even if either if these happens, if
you pay within 30 days nothing will be recorded which adversely
affects your credit ability etc. These companies try to frighten
you into paying.
Read up or search this forum on what a “CCJ” really means. For

I have today received an email from the SRA which says they have
closed my case, although to me it sounded as though it is
because they are already investigating. It states:
We appreciate the concerns raised by *** about this specific
case. We are also aware of wider concerns raised about the
firm’s correspondence and are currently engaging with the firm
about the following issues:
•
Aggressive/misleading correspondence
•
Inadequate content in letters before claim/action and failure to
correctly identify the alleged debtor
•
Unfair advantage
However, we do not consider a separate investigation is required
into these issues.
So I imagine I just sit and wait for the next letter from
Moorside. Last one was Notice of Claim but I have not receieved
a claim.

We have learned from other plaintiffs that Moorside are actively
being investigated by the SRA.
As a result the SRA are not acting on additional complaints
regarding Moorside where those complaints are broadly along the
same lines as the ongoing investigation - TBH, that seems
totally reasonable in situations where the fresh complaint does
not bring any new evidence of wrongdoing.
This appears quite serious for Moorside.
I have also had eyes on a further document from Moorside where
they appear to admit that they have struggled with compliance
since the outcome of Mazur - I can only assume that they have
become over reliant of non-qualified personnel - given that they
are serial litigators they now appear to find themselves in a
position where there are insufficient qualified personnel to
carry out tasks that are considered to be 'conducting
litigation'.
There are likely to be a number of so called 'law firms'
involved in private parking enforcement who find themselves in
the same boat.
Interesting times!
