       Dear Friends,
I am reaching out for a family friend who is not computer
literate. They got a PCN dated 23/05/25, reason for issue:
Parked on a Roadway where Prohibited. They were dropping a
customer off and was there between 0:47:39 - 0:49:08.
The location is Prince Of Wales Drive, SW8 4AA. They have
appealed the initial parking charge stating that they were
dropping customer off, however as usual that was refused. They
received few letters from dcbl with the usual spat, however
without a Claim form they have received a Judgement for Claimant
(in default] double sided letter from Northampton dated 04/11/25
demanding £175.21 for the claimants debt and interest and £107
       for costs.
I will try and scan all letters tomorrow at work but in the
meantime any advice would be most appreciated.
       Kind regards

Are you telling us that nothing was received after the debt
       letter dated 5th September?

Yes that was the only letter before the court doc.

Are you confirming that the Judgment Order was printed on the
back of the generic claim cover letter? That was the only
document included in the letter from HMCTS?

       Yes it was, double sided.

A few months ago, there were a spate of these default CCJs where
no claim was ever received and the first the defendant knew
about the CCJ was receipt of a single page with a claim cover
letter printed on one side and the Order on the back.
I wasted a whole lot of time trying to get HMCTS to confess to
an internal system error and have these CCJs set aside
administratively, but they would never admit a fault except that
the fact the order was printed 9n the back of a claim cover
letter was due to a printing error in their Xerox room.
Whilst I am certain that it is part of a massive flaw in their
IT system, they will not admit it. They refuse to provide
evidence of having posted the original claim even though it is a
rebuttable presumption that it was delivered.
Do a search of the form for a whole bunch of these cases. All I
can suggest is make a lot of noise and complain to HMCTS and get
       your MP involved.
You can apply for a set aside but it will cost you £313 for the
privilege and the claim would still be live. Or you can try and
sue HMCTS and put them to strict proof of posting the original
claim. They would be required to provide evidence of the actual
date the claim was entered into the postal system.
Have a read of these articles that highlight a serious cover up
at HMCTS over damaging bugs in their IT system:

Thanks B789, apart from setting it aside what other option is
there as the cost is quite high. Any examples of complaints
would be very helpful and the best place to send to. Many thanks
