       The Assessor has totally misrepresented Elliot v Loake. He
       should have instead reviewed VCS v Edward.
       This taken from another case...
       You refer to Elliot v Loake (1982) as case law which supports
       the view that the owner of the vehicle, if there is no contrary
       evidence, is the driver.
       This is an incorrect representation of the case for the
       following reasons:
       The facts of the case are that the appeal judge ruled that the
       appellant was the driver because of the ample evidence that he
       was the driver, and not, as you incorrectly state, because of
       the lack of evidence as to who the driver actually was.
       In the case there was ample evidence that justified the
       magistrates to conclude that this man was driving his blue
       sports car on the night when it collided with the stationary
       car.
       Additionally, a crucial part of the case was that forensic
       evidence showed that the appellant lied. Other material facts
       were that the driver had the only keys in his possession that
       night and that no-one else had permission to drive the car.
       This case does not therefore introduce any binding legal
       principal as this case turned on its own facts. If any principle
       can be adduced, it is the well known principle that once a
       witness has been proven to have lied in one respect, it is
       likely that their evidence elsewhere is also false.

       Thanks for this Intercity. I think from previous comments from
       b789 that was always going to be the case, and, as predicted,
       though they say they are legally qualified - the anonimity that
       goes with the response suggests otherwise.
       Keen to here from b789, or anyone else that has far more
       expierience in this as to next steps etc and what to expect.
       I'm still in disbelief to be honest that it comes to all of this
       - over £1.50 - that was actually paid, but not taken by them.
       Job validation and greed at it's finest I suppose!

       Nothing to do now.
       Just wait.
       They'll be loads of begging debt letters which can safely be
       ignored.
       Wait for a letter before claim or similarly worded letter and we
       can then consider a response.

       They have up to 6 years from the date of the parking event to
       raise a claim, but there's no good reason for them to take that
       long and it's relatively rare for them to take that long. It is
       usually within a year to 18 months at the latest. If you move
       house whilst this is ongoing remember to write to the parking
       company and inform them of your new address for service.

       Thanks for confirmation - we're now 5 months on and still
       nothing - all of this over £1.50 - beggars belief.

       It’s not about £1.50, the contract Alliance Parking has is very
       likely that it collects and hands over all money to the land
       owner, in return for which it gets to pursue anyone it thinks to
       be breaking the rules, and to pocket the money it extracts from
       them.
