Euro Car Park - Only final notification & no images (passed
28 days)

Final notification, for the first time.
Hi all. Looking for a bit of help.
The Mrs received a Final notification (for the first time) for
an alleged parking offence. She knows the alleged parking spot
and doesn't recall parking there. It's a euro park carpark and I
think it uses ANPR Cameras.
She never received any notice of the alleged contravention other
than a final notification sent in the mail just over 1 month of
the alleged contravention, saying that there is an outstanding
balance and the discounted amount no longer applies.
When she received the letter I went online to see if there were
any images, as she doesn't believe she parked there, and there
are no images or even any details of the contravention.
Since then (after checking online) she had misplaced the final
notification letter. She has recently found it but it as passed
the 28 payment day with no appeal made so now she has received a
2nd letter in the form of a payment demand from Debt Recover
Plus. Logging on to eurocarparks.com currently diverts the case
to the Debt Recovery Plus website so it seems like appealing is
no longer an option. However I did take a screenshot online
before this.
Below I have provided a screenshot of the final notification
letter (which is the initial notice received regarding the
alleged incident).
I have also provided a screenshot of the case when I logged into
eurocarparks.com Luckily I took a screen shot when I was able
to login before the 28 days. The screen shot shows the only
details I was able to find regarding the case. There were no
images or available to view.
What can we do now that the issue is with Debt Recovery Plus?

Is your wife the reg keeper (i.e. not on lease or PCP)? If so,
is the address on the V5C correct (don't assume, get it out and
check)?

Doesn't really matter. No one pays a penny to ECP if you follow
the advice. Check the V5C for the correct address but not much
point in trying to appeal it now.
You can safely ignore all debt recovery letters. Debt collectors
are powerless to do anything except to try and intimidate the
low-hanging fruit on the gullible tree to pay up out of
ignorance and fear. You can safely shred any debt collector
letters and use them as hamster bedding.
This WILL end up being a county court claim, which is a good
thing. We will advise on how you defend the claim and I can say
with greater than 99.9% certainty that the claim will either be
struck out or discontinued just before they have to pay the £27
trial fee.
Come back when you receive a Letter of Claim (LoC) from DCB
Legal and we will assist from there.

Thank you for your response (both of you). The Address is
correct on V5C. Additional instructions appreciated. I
understand a letter of claim is not a CCJ but does a letter of
claim affect a mortgage application. Mortgage is happening until
middle or early next year so I'm guessing there's time to solve
it. Also, will defending the claim require in person appearances
such as court appearance? Just trying to work out the most
feasible option from our perspective.
Thanks.

Letter of claim has no bearing on mortgage, credit, or anything
similar, it’s just a letter. Search this forum for explanations
of what a “CCJ” is and isn’t, these words are only used at this
stage to frighten you into paying.

Even if you were to ever receive a CCJ against you, as long as
it is paid in full within 30 days of judgment, it would have no
effect as it is completely expunged from the record.
Nothing we advise on here will make anyone get a CCJ.
A County Court Judgment (CCJ) does not just happen—it
follows a clear legal process. If someone gets a Parking Charge
Notice (PCN) from a private parking company, here's what happens
step by step:
1. Parking Charge Notice (PCN) Issued
• The parking company sends a letter (Notice to Keeper)
demanding money.
• This is not a fine—it’s an invoice for an alleged breach of
contract.
2. Opportunity to Appeal
• The recipient can appeal to the parking company.
•If rejected, they may be able to appeal to POPLA (if BPA
member) or IAS (if IPC member).
• If an appeal is lost or ignored, the parking company demands
payment.
3. Debt Collection Letters
• The parking company might send scary letters or pass
the case to a debt collector.
• Debt collectors have no power—they just send letters and can
be ignored.
• No CCJ happens at this stage.
4. Letter Before Claim (LBC)
• If ignored for long enough, the parking company (or
their solicitor) sends a Letter Before Claim (LBC).
• This is a warning that they may start a court case.
• The recipient has 30 days to reply before a claim is filed.
• No CCJ happens at this stage.
5. County Court Claim Issued
• If ignored or unpaid, the parking company may file a
claim with the County Court.
• The court sends a Claim Form with details of the claim and how
to respond.
• The recipient has 14 days to respond (or 28 days if they
acknowledge it).
• No CCJ happens at this stage.
6. Court Process
• If the recipient defends the claim, a judge decides if
they owe money.
• If the recipient ignores the claim, the parking company wins
by default.
• No CCJ happens yet unless the recipient loses and ignores the
court.
7. Judgment & Payment
• If the court rules that money is owed, the recipient
has 30 days to pay in full.
• If they pay within 30 days, no CCJ goes on their credit file.
• If they don’t pay within 30 days, the CCJ stays on their
credit file for 6 years.

Conclusion
CCJs do not appear out of thin air. They only happen if:
• A parking company takes the case to court.
• The person loses or ignores the case.
• The person fails to pay within 30 days.
If you engage with the process (appeal, defend, or pay on time),
no CCJ happens.[/quote

Hello good people,
Just a quick update on this.
I have received what seems to be a final debt letter but this
time it came with an addition checklist letter saying legal
action is imminent. I'm assuming that the next letter will be
the letter of claim we are waiting for, which I will post here,
but I thought I'd share this for thoughts too in case I'm
overlooking something.
