       A winner but the adjudicator is wrong about code 12 as it's not
       a shared use bay. only a pay bay.

       cancel the Penalty Charge Notice.
       Reasons
       Mr xxxx attended this Teams appeal hearing. The authority did
       not attend the hearing.
       Mr xxxx relied on his written grounds of appeal.
       ‘The traffic sign is incorrect (see attached);
       2) The contravention code (06P) is incorrect and hence the
       contravention did not occur.
       The traffic sign in evidence states: Pay at machine. Display
       ticket.
       The machine accepts payment and advises that parking rights may
       also be obtained via RingGo, which is also confirmed on the
       council's website.
       The alleged contravention is that of failing to display a
       ticket, NOT failure to pay.
       The actual wording of the contravention cannot be correct in
       that the parking place
       accepts phone payment and therefore not displaying something
       whose display is optional cannot be correct, surely. Likewise
       the sign doesn't reflect the option to pay by phone.
       It therefore follows that:
       The traffic sign in evidence is incorrect because display of a
       ticket is not an obligation;
       and
       The contravention is wrong for the same reasons.’
       He explained that he parked for over 5 minutes to buy medicine
       for his child. He did not attempt to pay for parking by any
       method.
       He suggested that the officer explicitly sanctioned parking
       without payment for 5 minutes.
       The officer’s notes record the driver returning after the
       penalty charge notice was issued. The notes do not corroborate
       sanctioning parking without payment in a clearly signed pay bay.
       In the absence of corroboration, I find that no parking without
       payment was sanctioned.
       The civil enforcement officer’s notes that the vehicle was
       parked without online payment and without a valid pay and
       display ticket clearly on display between 09.39 to 09.45.
       The officer’s photographs establish that the pay machine in
       question accepted payment at the machine. Signage established
       that online payment was also accepted via an app.
       The contravention code relied on in this instance was’ Parked
       without clearly displaying a valid pay & display ticket or
       voucher’
       The applicable contravention code according to London Councils
       Penalty Charge Notices: Contravention Code List is:
       ‘12 arstuwy4 Parked in a residents’ or shared use parking place
       or zone without a valid virtual permit or clearly displaying a
       valid physical permit or voucher or pay and display ticket
       issued for that place where required, or without payment of the
       parking charge.’
       This is so because signage clearly stated that payment was
       required with different options as to how to do so.
       The appeal is allowed .

       Many thanks to the forum for their assistance with this even if
       it was a 'strange decision' by the adjudicator :)
