Newham towed car while on holiday

Hi Everyone,
On 24 June 2025, my car was towed while I was on holiday. I
later learned that the parking bay had been suspended during my
absence.
I had parked my car there on 13 June 2025, at which there was no
suspension notice displayed. I hold a valid resident permit
allowing me to park there at any time.
When I returned on 3 July 2025, I discovered my car was missing.
After checking the Newham Council website, I found out it had
been towed. I had to pay £800 to retrieve it.
I submitted an appeal to Newham Council explaining that I was
away when the suspension notice was posted, but they rejected my
appeal.
I now intend to take my case to the London Tribunal and would
appreciate any advice on how to proceed.

Post the rest of the rejection letter and also your reps.
A decent council would relocate not impound a vehicle with a
resident's permit that was parked before a suspension sign went
up but this is Newham.
Are there any arrangements you could have made to check on and
move your car.
I've checked Newham's PCN system and they've taken all the pics
down but it says £440 is outstanding.

They haven't said specifically they've dismissed your holiday as
a reason to consider only just telling you to go away as you had
no 'exemption'.
But that's not a reason to impound a resident's car as they have
the option to relocate to a non-suspended bay.
You need to register the tribunal appeal and opt for a telephone
or online hearing.

OP, are you a Newham resident and were you displaying a valid
permit, in this case 'S'?
The objective facts are that you were parked in a suspended bay.
The council was therefore permitted to remove your car subject
to the regs and the proportionate and correct implementation of
their removals policy....which you haven't seen.
IMO, they were not obliged to move your car to another location,
they were required to comply with their published removals
policy.
In addition to registering your appeal - your grounds at present
would be 'penalty or other amount ...exceeded to amount
applicable in the circumstances of the case'- you must obtain a
copy of their removals policy.
I would write to them...

Further to your Notice of Rejection of my representations in
respect of the above, I have registered an appeal and am
compiling my defence. In this regard, please supply a copy of
the council's Removals Policy.

PLUS - pl look at the PCN number on the receipt and PCN and
compare with the one on their Notification of Removal dated 2
July?

Yes I am a Newham resident and have the “S” permit (e-permit). I
just submitted a request to Newham of when they put up the
suspension signs and what work they have undertaken coz there
seems to have no work done at all at the place where I parked.

Look at the notices to which I referred. Any idea what the PCN
number refers to?
You must write to the council to get a copy of their removals
policy.
I just submitted a request to Newham of when they put up the

IMO, it is not a statutory defence to claim that you parked
before the signs went up, this would be an anarchist's charter
if it was correct.
You don't know what works were being carried out (beyond what's
on the notice).
Info you do need and which needs to be reiewed as regards your
defence is:
When was vehicle authorised for removal;
When was it removed;
The council's removals policy.

It might prove useful to find out when the suspension signs were
put-up.
And the record of vehicles found parked there when the signs
were put up
