       Hope this finds you well[member=103]DWMB2[/member]
       [member=26]b789[/member] and [member=636]jfollows[/member].
Further to this, I have received Mediation Appointment
       Confirmation email from
       <NoReply_SCMS_Confirmation[member=6517]justice[/member].gov.uk>
along with the attached form which is copied down for your
attention. Could you please guide me what would be the next step
       please?
       Best wishes & Kind Regards
       Delegation of authority to mediate
You need to fill out this form because when both parties agree
       to a
settlement during mediation, it becomes a legally binding
       contract
       with important legal consequences.
Filling out this form means you authorise your representative to
       agree on
your behalf. If they agree to a settlement, you’ll be legally
       bound by the
       terms of the agreement.
       1. What is your claim number?
       2. What is your name?
       3. What is the name of the person to whom you are delegating
       authority?
       4. What are their contact details?
       Email
       Phone
       5. I agree that the person I’ve given authority to can suggest
a resolution for this case. If both parties agree to the
       proposed
settlement, I’m willing to be legally bound by the terms of that
       agreement.
       Return your completed form by:

For the mediation call, the only requirement is for you "attend"
the call. It is not part of the judicial process and no judge is
       involved.
This is what I advise you to say when you receive the call from
       the mediator:
“Before I set out my position, please confirm from the
       claimant’s side:[/I]
       [indent][I]• the full name of the person attending for them;
       • their role/position at their legal representative’s firm; and
       • whether they hold written authority to negotiate and settle
       today.[/indent]
Please relay that back to me before we continue.”
       After the mediator calls back...
       If identified and authority confirmed:
[indent]“Thank you. I’m content to proceed on that basis. My
settlement offer is £0, or I invite the claimant to discontinue
with no order as to costs.”[/indent]
       If no/unclear authority:
[indent]“Please record that the claimant’s attendee has not
confirmed settlement authority. My position remains that
liability is denied and my offer is £0, subject to prompt
approval by an authorised solicitor if they choose to
       discontinue.”[/indent]
If the mediator probes your defence:
[indent]”[I]In what capacity are you asking that question? Are
you legally trained? If not, please refrain from offering
opinions. I will be reporting any attempt to do so as
       inappropriate[/I].”
All you need to know is the name and the position of the person
acting for the claimant and report that back to us. It will be
over within minutes. Complete waste of time otherwise.

Hearing nothing is not necessarily a good sign
[member=6480]dioxide[/member] - if the matter has been
discontinued you should have had a notice of discontinuation.
Does anything show up on MCOL?

       hello again guys
       [member=636]jfollows[/member][member=26]b789[/member][member=103]DWMB2[/member]
you guys are awesome throughout this and I want to take this
opportunity to thankyou all for your continued guidance. I have
finally received an email yesterday from DCB Legal stating their
client has instructed them to discontinue court proceedings and
close our file enclosing the Claimant’s N279 Notice of
       Discontinuance for my record.
Should I be helpful and adding value to this forum please let me
know the ways. I feel indebted to this forum as it has taken me
out of this mess causing awful pain and discomfort.
       Wishing you all the best
       Kind Regards
