       PCN parking in own bay

       My home has a dedicated parking space where I have sole use for
       a roadworthy vehicle.
       The estate has recently employed a private car parking company
       to manage the spaces.
       A ticket was issued to my sister who had permission from me to
       park within the space.
       As I failed to register he vehicle as a guest, she got a PCN.
       We appealed and it was declined. It’s taken a long time for me
       to process this and the Popla appeal needs to be appealed by the
       4th August.
       Could I have advice?
       I did not give consent to the management company to manage my
       space. But I also believe the ANPR camera is fixed on council
       land and not estate.
       Could I argue a contract was not agreed to, as I didn’t give
       permission for my space to be monitored?

       As well as the above, the following will be important:
       - Exactly what your lease does (and does not) say about parking.
       Please show us the exact wording of any clauses relating to
       parking, and anything in your lease that demises that space to
       you for your use
       - A copy of what you put in your appeal

       You’re gonna need to show the PCN as well if possible. Front and
       back. Make sure you hide your address, though
       We also need a copy of what you said in your appeal.

       The appeal is quoted above in IMG_5586
       There may be a similar POPLA appeal here on the forum, there is
       a search capability, from everything said here the “parking
       company” has no contract indeed, your right to use the parking
       space trumps them.
       If POPLA doesn’t uphold your appeal, the speculative invoice
       would not stand up to court scrutiny. It would definitely help
       to know exactly which useless money-grabbing bunch is trying it
       on here.

       The leaseholder has supremacy of contract and there is no
       requirement in the lease that mentions they are bound by a third
       party. Explain to POPLA that you put the operator to strict
       proof that they hold a valid contract flowing from the landowner
       that supersedes their own lease.
