       ParkMaven Limited - Overstayed authorised parking session -

       Hi there!
       Looking for some advice as to how best to approach this PCN I
       received as the keeper of the vehicle.
       On 19th July, the driver entered the car park, found a parking
       space, parked up and entered the premises and proceeded to
       check-in, unload the car, go up to the room, etc. The driver
       didn't realise until the morning of departure (20th July) that
       they needed to pay for parking upon arrival: the signage in the
       car park was poorly lit and the signage inside the premises was
       tucked around to the left and out of eyeshot when the primary
       focus is checking in - for which the kiosks were straight ahead.
       On the morning of departure, the driver did pay for parking
       (albeit only 15 minutes) to show reasonableness in attempting to
       correct the mistake prior to leaving, rather than leaving
       without paying at all.
       It's worth noting that I'm not one to skip paying for parking
       where I know I need to pay, both as the driver and the
       registered keeper of the vehicle.
       I've attached a scan of the PCN with personal details omitted,
       for reference.
       Final note, I am opening to paying the £60 reduced fee if people
       think it's not worth contesting.

       Plan A should be to contact Premier Inn and ask them to get it
       cancelled - offering to pay the required parking fee as the
       driver was a genuine customer.  How much was paid / vs the
       overnight fee?
       The PCN is arguably not fully compliant with POFA, there being
       no 'invitation' to pay or name the driver.  This will never get
       anywhere with the parking co, but might work at POPLA (esp as
       this was a genuine customer).  Otherwise you would have to wait
       for a court claim and defend it there with help from here -
       which is almost always successful.
       Paying is always an option, and your choice, but not generally
       the one supported here!
       Edit - removed the incorrect bit about the inviation - I was
       reading the second page where it says 'you should' and totally
       missed the obvious bit!

       The invitation and to name the driver are there in the third
       paragraph.
       The premier Inn location might well be on the Airport Land, and
       if so it is not private land and would be considered to be
       covered by bylaws.

       Way
       is a E-W road to the south of the airport limits.

       I now the location very well and have stayed many nights in that
       Premier Inn. It is NOT on airport land and is therefore relevant
       land for the purposes of PoFA.
       There never used to be a parking fee for registered guests and
       all you had to do was input your VRM into a pad or if parking
       was not included, you paid for it at the time of booking and
       when you checked in, you provided your VRM. It may have changed
       since, as this was over 5 years ago.
       The NtK is PoFA compliant and so whether the driver is
       identified or not, the Keeper can be held liable.

       This part of the opening post stands out to me - is there a
       reason that the driver only paid for 15 minutes, rather than a
       tariff that matched the length of time they had stayed?

       Hi everyone!
       Thanks for all the replies and the assistance so far. I didn't
       realise the hotel would be able to do anything their end, but I
       called Premier Inn as advised and they're going to cancel it
       (thanks [member=885]RichardW[/member] for the advice)! Judging
       by the tone of the person I got through to, this isn't the first
       time they've had complaints about PCNs...
       To answer a couple of questions posed in the replies:

       Unfortunately, they've changed from a barrier/ticket system
       quite recently and you just drive in and pay at a kiosk inside.
       No opportunity to input your VRN on the booking so it seems this
       is the only way to attain parking now.

       There wasn't an option to pay for prior arrival, only pay from
       now until you plan to depart. Bit cheeky if you ask me as it's
       an easy money grab if you leave earlier than expected or depart
       later than expected!

       The PPSCoP was changed recently so that as long as payment for
       the period of parking was made, irrespective of whether that was
       on entry or exit, no PCN should be issued. I reckon they just
       went after you because you only paid for 15 min parking instead
       of whatever the tariff should have been.
       However, if you only have the cancellation promise by phone, you
       will need to get some written confirmation of this as you will
       not be the first person where they are suddenly surprised,
       several months down the road, when they start receiving debt
       recovery letters or a Letter of Claim (LoC), because whoever you
       spoke ti was then distracted and forgot to actually do the
       cancellation deed.

       Interesting, I guess they rely on people not being 'up-to-speed'
       on legislature changes.
       I was told to send an email with the PCN attached and they'd
       cancel it from there, so just started a written chain and also
       requested that they reply once the PCN is cancelled. I wouldn't
       be surprised if ParkMaven still try to chase me for the monies
       owed, but at least I'll have the email chain to prove.
