Haringey PCN up to £160 didn't receive first letter

Hi All
I received a PCN from Haringey the PCN was torn off the car and
I haven't received the first letter I have requested them to go
back to discount price but it was rejected
I have not received the first letter at all

There is no first letter - the windscreen PCN is the first
thing.
You got a notice to owner presumably? Let's see it.
But this is unpleasant - we are seeing more councils get tough
on getting the full amount but most will still offer the
discount for a lost PCN.
Unfortunately the tribunal can't use mitigation to cancel if
there is evidence the PCN was served, but you have nothing to
lose by appealing and making Haringey pay to contest it.
But .... what were your reps? They say they won't cancel but you
say you were only asking for the discount?

Register your appeal.
Grounds Procedural Impropriety.
For info, the Notice of Rejection:
1. Fails to inform you correctly of your rights of appeal;
2. Fails to inform you correctly of the council's power to serve
a charge certificate.
1a - because you only have a statutory right to register an
appeal up to the end of the period of 28 days BEGINNING on the
date of service of the NoR;
1b- because you were not informed that the adjudicator may
register an appeal AFTER the end of the 28-day period.
2a- the council may only serve (not send as they have said, but
serve) a CC after your STATUTORY appeal period has ended.
Therefore it follows that by specifying this with reference to
the incorrect date base in 1a they have failed to inform you
correctly of their power in this regard.
Each of the above is mandatory and therefore by failing to
comply with the regulations they have committed a procedural
impropriety in EACH case.
In short, they're incompetent, but sadly this is not grounds of
appeal!
You should register your appeal by 10 August - NOR issued Thurs.
10 July, deemed served Mon. 14th which is day 1 of the 28-day
period.
But do it beforehand, you don't want to miss deadlines.
Wait for other comments.

It's a no-brainer to now appeal to London Tribunals, as the
penalty doesn't increase and there are no additional costs.
Any reason for not paying for parking at the location on the
original PCN ?

Why? Were you and, more to the point, how could you prove this
and even if you could do you know that 'loading' is an
exemption?

Same thing has happened to me... but twice!! Did you resolve
your issue?
