If you search the forum for
mediation
you will find lots of advice.
Essentially you offer £0 to settle and you do not discuss your
defence. The mediator has no legal standing or authority. When
you make your position clear, the mediation session will be
concluded.
And please stop referring to the “driver”. The registered keeper
has received this, not the driver.

Thank you for the reply but this forum is a minefield for me and
I am really overwhelmed with all the jargon and navigation. Can
someone please send me what dialogue I should write in that
form? I read something regarding mediation but it was directed
further down the line. I just need to know what I am supposed to
have prepared in writing in front of me on the day I get the
call from mediation? What the outcomes can be and what to say in
the event of each outcome please?

What form?
You only use the EX750 if you’re trying to get someone else to
attend the mediation call instead of you. Is that what you want?

Thank you for your reply. Just to be sure that I understood this
correctly:
- Do I (the registered keeper and driver) ignore the form EX750
as I have no representative? Do nothing and wait for them to
call?
- If that is the case, is there a phrase or statement I need to
say on the day I get the phone call from the mediator? How
should I word it? What do I need to say? I would have to write
it down so I can read it back to the mediator on the day.
I value your input and advice very much :)

I have a telephone appnt with the mediator and I have trolled
the site to find out what I should say to them.
I managed to find a template so can someone please confirm this
is how it should go for me on the day please?
TEMPLATE:
For the mediation call, the only requirement is for you "attend"
the call. It is not part of the judicial process and no judge is
involved.
This is what I advise you to say when you receive the call from
the mediator:
"Before I set out my position, please confirm from the
claimant's side:
. the full name of the person attending for them;
. their role/position at their legal representative's firm; and
. whether they hold written authority to negotiate and settle
today.
Please relay that back to me before we continue."
After the mediator calls back...
If identified and authority confirmed:
"Thank you. I'm content to proceed on that basis. My settlement
offer is £0, or I invite the claimant to discontinue with no
order as to costs"
If no/unclear authority:
"Please record that the claimant's attendee has not confirmed
settlement authority. My position remains that liability is
denied and my offer is £0, subject to prompt approval by an
authorised solicitor if they choose to discontinue."
If the mediator probes your defence:
"In what capacity are you asking that question? Are you legally
trained? If not, please refrain from offering opinions. I will
be reporting any attempt to do so as inappropriate."
All you need to know is the name and the position of the person
acting for the claimant and report that back to us. It will be
over within minutes. Complete waste of time otherwise.

Yep that should do. It's all generally a quick process in these
cases, as neither party are usually prepared to compromise
enough to reach any sort of settlement.

The mediator has not called me during the given time frame as
mentioned in their letter. What happens now? Will they still
call me after the allocated time frame, or they'll just drop the
case?

Actually the mediator called on the last minute of the allocated
time and said that the claimant will take me to court as they
haven't accepted my £0 settlement offer. Mediator claimed to be
working for the small claims court and reluctantly gave me their
full name and said that they hold legal and written authority to
negotiate and settle today. So what happens now?

Hi Peeps,
I received a letter from small claims court asking me to put my
evidence forward and to appear in court in person.
It looks they are dragging me all the way to the end!
Any advice would be appreciated, please.
