       Date and time on the letter does not match location of the car

       Hi
       First time posting on the forum. I did go through "before you
       post" post. I hope I did not violate anything from there

       Long story short.
       Today, I received a "Notice of Intended Prosecution &
       Requirement for Driver Information", asking me to provide the
       details of the driver.
       The thing is that I am pretty sure I was not there at the time
       of the offence.
       So apparently I did 38mph on 30mph road in Bedford at 23:06
       while I think my car was parked next to cinema in Milton Keynes
       since I was in cinema watching a movie at the time. The only
       time I remember maybe being nearby the offence place is two days
       later but way earlier than 23:06.
       So I am not saying it did not happen but the time and date do
       not align at all and just makes me think if even that I just
       need to accept it or if there is any chance for me to dispute
       it. Did anyone hear about similar situation ?

       Currently you are being asked to name the driver of the vehicle
       specified at the time, date and location specified.
       The NIP does not alleged that you did anything, but that the
       driver of your car at the time, date and location specified did.
       If you are certain that your vehicle was not at the location
       specified at the time and date specified, then your vehicle
       cannot have been involved in the alleged offence, and you are
       not the person keeping the vehicle - so your obligation under s.
       172 RTA 1988 as "any other person" is to provide any information
       that is in your power to give and that might lead to the
       identification of the driver. That information would typically
       be that your vehicle was not at the location stated at the time
       and date stated, and would generally also include where your car
       was at the time and date in question.
       It might be prudent to think long and hard about where your car
       would have been at the time in question, and, if it is possible
       that the time and date might simply be wrong, take long enough
       thinking long and hard that it would be too late for the police
       is serve an amended NIP within 14 days of the actual time/date.
       N.B. Where you were at the material time is of minor relevance -
       it is where your car was that is relevant.

       Are you absolutely certain of your dates. Do you have the cinema
       ticket to prove it.  Were your keys in your pocket.
       If so either their nip has the wrong date/time or the car wasn’t
       yours (plate misread or cloned).
       As advised wait 14 days before replying
       (although you don’t say if it’s your car and you have the log
       book, which would negate the 14 day wait.  Have you double
       checked the reg on the NIP? E.g you lease the car and the
       finance company have provided the wrong clients details
       accidentally after misreading the reg)

       Yes the car is mine and I do not share it with any other
       drivers.I am certain I was there at that time.
       I've got tickets confirmed and I think even the parking next to
       the cinema has cameras there so maybe I could request proof that
       my car was parked there.
       The movie was at 19:00, the movie was 2 hours 50 min and plus
       ads before movie started so I did not leave cinema until after
       the alleged offence.
       I really start to think about misread red or cloning. Cloning
       sounds scary since it means someone did it on purpose but I hope
       for the first option.
       I will wait 14 days like you said. Maybe in meantime I will find
       out if I can request cctv or proof that my car was parked at the
       time next to cinema ? This might take a while.

       Are you sure you left the cinema after the time of the alleged
       offence?
       Film ended c. 21:50 offence at 23:06

       Yes since there are still ads playing for good 15 min. So movie
       did not start until 19:15 ish. On top of that it takes 25 min to
       get to the place of the offence from cinema and it is in wrong
       direction anyway since I do not drive through bedford. I drive
       south.

       It may not help you but you could contact them asking for any
       pictures to assist in identifying the driver. It's a long shot
       at night but it might reveal something.

       There are two schools of thought -
       if the OP requests photos to help to identify the driver, and
       after seeing that the photos don't contradict his subsequent
       claim, then responds by saying that his vehicle was elsewhere,
       that runs the risk of sounding like his dog ate his homework,
       but
       if the OP asserts that it his car was not at the
       time/date/location in question, the police are likely to refuse
       to share any information/evidence.
       If the OP is certain that his vehicle was not at the
       time/date/location in question, then arguably the benefit in
       seeing the photos would be minimal. That said, if the OP thinks
       that a 3h05m movie (including trailers) was still playing 4h06m
       after it started, I might need to get some more popcorn in.

       Your timings don't make sense.  You could have got to the
       offence location and still have about 36 minutes to spare
       according to your times.
       (When you say 19:00 do you actually mean 9pm ie 21:00)

       Ok I cannot count today 🤦 You are right it was after
       movie. Even if I stretch it and count 2h 50 min movie and 20 min
       of ads it would be 22:10 I left the cinema. Still I did not
       drive in Beford direction. I live in Luton direction. On letter
       it says Bedford kempston as camera location. I was pretty much
       home by 22:40ish it takes 30 min for me to get home
