Newham Council – Contravention Code 53J – Failing to comply with
a restriction on vehicles entering a pedestrian zone

Hi All
I recently received a PCN in the post for driving through a
School Street during its restricted hours. After reviewing the
footage, I realised the mistake was mine — I hadn’t read the
sign properly.
The sign was no vehicles between 8.30- 9.30am and 3-4pm, Monday
– Friday.
I entered the restricted area on Tuesday 3rd of June at 3:53 PM,
just seven minutes before the restriction ended at 4:00 PM.
I’m wondering:
• Is there a realistic chance of appealing this ticket
successfully?
• If so, what grounds could I use for the appeal?
I’m not contesting that I drove through during the restriction,
but I feel it was an honest mistake, and the timing was very
close to the restriction lifting.
There are no signs on google street view as the signs have only
been put up not long ago and google has not updated there maps
yet.

greatly appreciated!

Well, the video shows you approaching the signs head-on, with no
hesitation. I have to say it does look as if the contravention
is made out. Seven minutes is not in de minimis territory, I'm
afraid, so you'd be looking at a 'technical' appeal based on
Newham mismanagement of the enforcement process.
There are two chaps on here who know the ins and out of these in
London, Hippocrates, and the administrator, cp8750. The latter
is extremely busy, and Hippo is on holiday at the moment. It
would be helpful if you could post up a screen capture of their
website pages for submitting representations. It has been found
that with some councils these show unlawful demands for money,
and this has won appeals in the recent past.
