im going to fill out the appeal papers today and send them back,
but it seems so ridiculous when i can clearly show payment.
As you will. But pl stop what is tantamount to a charade* by
continuing to use your niece's address. According to you, you
have a permanent residence in a foreign country so you must make
this your correspondence address and IMO send proof to the
tribunal. Perhaps this might jog TfL into just abandoning their
pursuit.
In your appeal YOU MUST set the scene i.e. live in ****,
visiting your niece for 3 weeks, somehow obtained a UK
registered vehicle for this purpose, became RK on ** and
permanently exported the car on ****. (these details a very
sketchy in your posts)
Then worry about arguing that you paid the road user charge.
*- plus of course if this were to play out to its fullest it
would be her property visited by bailiffs because for all anyone
knows this is where you reside.

Hi,
just an update, finally got a call from someone competent at TFL
yesterday afternoon, and they've cancelled the PCN, he said i
can see you made the payment so everything is OK, got an email
to confirm as well.
thanks for all your replies.
I registered the car at my nieces with her permission, as it
needed to be registered to a British address when purchased, it
was exported a couple of weeks later, and is now re-registered
in France, it was insured, taxed and mot'd - not sure why that's
a charade.

not sure why that's [tantamount to] a charade.
Because TfL and subsequently enforcement agents treat and would
have treated this address as being one for service of documents
on you and ultimately execution of a warrant to seize goods when
in law your link to the property was temporary and now
non-existent.
Thankfully TfL have cancelled anyway, but IMO by way of info for
other readers who might peruse this thread later always make
sure that the enforcement authority, whether TfL, London borough
or whatever know where you live for the timely service of
notices. As a general standard, the law presumes service 2
working days after posting and as periods for action are always
time-limited it is a risk worth taking to rely on a third party
(unless you want to keep your abode/whereabouts of property
hidden which clearly doesn't apply in your case).
