50r right turn at Reede Road, Dagenham

       Hello everyone,
I have received a PCN for making a right turn into Lidl as I did
not see the right turn prohibition as it was on the left side of
       the road.
It seems like a lot of people get caught out by this.
Has anyone successfully appealed against Barking & Dagenham
       against this type of PCN?
       Thanks.

       Hi,
Thanks for the response and information John and @cp8759
       Here are the details:
I received a PCN from Barking & Dagenham council for performing
an illegal right turn (50r Performing a prohibited turn (no
right turn)) at Reede Road (Dagenham) Jcn with Service Road
       Opposite 9-13 at 0950 on 21/05/2025.
I did not see the no right turn sign, which is in force Mon-Sat
between the hours of 8am-10am and 4:30pm-7pm, as this is on the
pavement on the left hand side. Also this is immediately off the
junction of Reede Road and Heathway and it's not possible to see
this sign unless you have already committed to the right turn.
The google map link to this location is here:

The link to the PCN, council images and council video is here:

       Kay.

The sign is quite new, but it's almost right on the turn, with
restriction times that have to be read whilst one is on
approach, so in my view this is inadequate under Regulation 18
of The Local Authorities’ Traffic Orders (Procedure) (England
       and Wales) Regulations 1996 : -
  HTML https://www.legislation.gov.uk/uksi/1996/2489/regulation/18
A timed restriction like this needs an advance sign so that a
motorist can, at the 20mph limit, read the restricted times, and
not at the point of turning. However, whilst this is a valid
argument, it would only get tested at London Tribunals, the
council will inevitably refuse any representations you put
forward, and hide behind the fact that the discount option
ceases at the Notice to Owner stage.
There may also be a 'technical' appeal based on B & D
mismanagement of the enforcement process, so wait a bit to see
what may be suggested, but don't miss the deadline to pay or
       submit representations.

I won a case here two years ago following which the council
improved the signage (they moved the left hand sign further
forwards and to the right) and I think it is now adequate in the
eyes of almost all adjudicators. Of 138 cases at the tribunal
only 29 have been won. Cutting the corner made the sign less
easily spotted (a point an adjduicator has made in a different
       case I was fighting).
There is a warning sign on the right on google street view but I
can't speak as to the current status of it.
I see no grounds to beat this PCN.
