       Islington PCN 12 - Parked in a residents or shared use bay

       hi,
       I wonder if I have a shot at getting this challenge accepted. So
       the vehicle was parked in a 'business permit holder bay' when
       the driver had a residents permit. I understand the difference
       and that residents' permits do not extend to business permit
       holders. However, on this occasion, as you can see in the
       pictures I have attached, the sign saying Business permit
       holders only was so far down the street. The picture that the
       traffic office took was all the way down the road.
       Compared to the distance of the signs on the opposite street,
       there was no Business permit sign close enough to where the
       vehicle was parked.
       The closest sign, which is just about 4 feet away from the
       vehicle that is alleged to have made the contravention, is a
       resident's permit sign.
       My challenge is that the either there is a sign missing or, this
       is an error on the part of the council. @cp8759

       Islington will say you must consult the sign(s) that apply to
       your bay and so do we. In London especially bays often differ in
       who they are for and when.
       But this is a very long business bay and has a sign in the
       middle and at the other end.
       But it is a shared use bay - business permit and pay bay.
       In March 2023 it had a sign at your end but it then disappeared.
       They do have a duty to sign bays well and it is not an
       unreasonable assumption that such a long bay is for residents
       but I suspect you'd have to take them to the tribunal to see if
       an adjudicator would agree.

       Thank you very much for that, I'll use that picture I checked
       again today and the sign is still missing. I am going to
       challenge it on that basis, then. It is a long road, and the
       sign is missing where I parked, and the next nearest sign is for
       resident permits.
       If i am using the missing sign as a reason, what do i select in
       the challenge options, is this 'impropriety' on the council's
       part,  miscellaneous, or another reason?

       The next nearest sign if in different bay might just as well be
       on the moon.
       Are you a local resident and why did you park there.
       Woodbine a decent Irish pub last time I was there.

       Yes, I am a resident; my parking permit extends to that area.
       True, the different bays can say different things. most of the
       bays are resident permits. Thing is i have been parking there on
       and off for months, if not years, with no ticket. This is the
       first time hence i never noticed that it was a business permit.

       Dear Islington,
       I am challenging the PCN on the basis that the lack of signage
       misled me into believing I was parked in a resident bay.
       I am a local resident and permit holder for zone xx and saw
       space at the top end of a long bay and parked in good faith that
       I was in a resident bay. But I now see that bay, which stretches
       from xx to xx Blackstock Road, is designated as a shared use
       business bay.
       In such a long bay, I feel it is your duty to post and maintain
       clear signage as it seems unlikely that such a bay would not be
       for residents' use, and I see from Google Maps that there was
       until recently a sign very near to where I parked that would
       have alerted me to the bay type.
       But this sign is now missing.
       I enclose a picture from Google Maps of the sign that should be
       there and trust you will give consideration to cancelling the
       PCN on this occasion, and I hope this alerts you to reinstating
       the sign.
       I look forward to your positive reply and am happy to be of
       service.
