interesting, that paved area did not exist a few years ago and
the tarmac carriageway and kerb edging were where the DYLs are
placed. so I would suggest that the paved area (although very
misleading) is still part of the carriageway.

The bottom line surely is that the council, by their own actions
in placing the DYLs where they always have been placed, have
essentially declared that the paved area is carriageway. I don't
see how they can escape this.

you should make an informal challenge. something along these
lines or cut and paste verbatim, up to you
I make an informal challenge against the imposition of PCN
number xxxxxxxxx under the statutory ground that
The alleged contravention did not occur
Diagram 1018.1 found in the TSRGD 2016 at schedule 7 part 4 item
1 may be used only at the edge of a carriageway. I denotes the
waiting of vehicle's is prohibited at all times. If a
contravention occurred it would therefore be code 01 for the
contravention of Parked in a restricted street during prescribed
hours.
The PCN in question is however issued for code 62 Parked with
one or more wheels on or over a footpath or any part of a road
other than a carriageway.
The presence of the DYL shows that the area I Parked was in fact
carriageway and as such the reason that the CEO did believe a
PCN was due is flawed, the statutory content required at
schedule 4(2)(c)(c)the grounds on which the civil enforcement
officer issuing the notice believes that a penalty charge is
payable, does not stand up and the PCN should now be cancelled
