       25 - Parked in a loading place during restricted hours without
       loading

       Hi, please let me know if I have any chance if I take this to
       tribunal.
       I received a ticket for parking in a loading only bay. But there
       was no restricted hours shown on the sign so I thought it was
       invalid.
       There never use to be any signs to say loading only. Southwark
       council then put a sign saying “loading only” with no time
       restrictions such as “at any time” or hours shown.
       Since my appeal they have not only rejected my appeal but they
       have now updated the sign and added hours only.
       I feel like this is unfair bearing in mind that the sign is only
       restricted to Monday-Saturday and my PCN was issued on a Sunday.
       Please advise me if I should take this to tribunal and if yes
       under what grounds?

       Where is the sign in evidence?
       Were you actually loading or did you just park?

       I have attached the sign evidence when the PCN was issued. But
       they have now updated the signs with hours.
       I was not loading at the time the PCN was issued.
       But the sign has now been updated to mon-sat 7-7pm only.

       OK, the sign has been updated, but when you parked it just said
       "Loading Only". This means that the restriction applies 24x7 and
       they say this in their letter of rejection. I'm sorry to say
       that they are right. Any restriction sign with no days or times
       always means 24x7.
       However, they may have updated the TRO for this bay, but been
       tardy in changing the sign, so in actual fact, when you parked
       the TRO may have already shown the new days and times, so no
       contravention occurred. But you'd have to check the TRO, and
       this can be difficult. How many days between your PCN and you
       seeing the new sign ?

       I was issued the PCN ON 13/04 and they changed the sign around
       the 04/05 so around 21 days but before they fixed the sign (the
       one that use to be there was removed) it use to be mon-sat 7-7pm
       aswell.

       I had to go back to GSV March 2019 to get a shot of th e losding
       sign with days and times as you say was once there.

       A year earlier it was similar but different time allowed for

       There is no GSV view after their July 2024 view
       It would help if you can get a photo of the current sign.
       I strongly suspect that the TRO for this bay remains unchanged,
       from 2019 but the missing sign was replaced by a sign that did
       not reflect what the TRO says. To get to the bottom of this, you
       have to be prepared to take them to adjudication, where they
       will be forced to prove that the sign with not times was
       correct, and to explain why only a3 weeks later you saw the sign
       that had been in place in 2019. You would have to forego the
       discount, unfortunately. Of course if you win, you pay nothing.
       I have done a bit of delving, and have found this Southwark
       facility for viewing all the static restrictions in the borough.

       restrictions. The Loading Only bay is Mon-Sat 07.00 - 19.00
       MOn-Sat. The key info is in the Publications Box, where it says
       the loading bay days and times were applied on 10th June 2011

       Thank you for the information. I have attached the image of the
       current sign.
       I suspect that it was never changed otherwise why would they
       change the sign 3 weeks after issuing me with a PCN.

       What this means is that the sign with no times or days was
       erected in error, and the PCN is void, but getting them to admit
       it will be a struggle. I suggest you also contact your local
       councillor to complain about council stupidity.

       The restriction has always been 7 til 7 so as you parked at
       something past 4 you would have to talk quickly The road
       markings are clear and you are expected to know what a road sign
       means. An adjudicator may find that in the absence of a sign
       that reflects the order no contravention can occur but it is not
       a sure thing

       It's 7am-7pm Mon-Sat, but the OP parked on a Sunday. Surely if a
       sign does not reflect the TRO for the bay, no contravention has
       been committed ?
